für die Aussage "Geistiges Eigentum gibt es nicht" wirst Du sicherlich hier überwiegend Zustimmung erhalten.
In der Tat ist es eine sehr verkürzende Analogie sogenannte Immaterialgüterrechte mit Eigentum an Sachen im Sinne des bürgerlichen Rechts gleichzusetzen.
Unbeschadet dieser verfehlten Terminologie gibt es aber Immaterialgüterrechte und auch wenn man über ihren Inhalt und ihre Ausgestaltung nicht nur nachdenken, sondern auch streiten kann, kann man ihnen nicht jeglichen Sinn absprechen (s. z. B. "Copyleft").
Und wenn man den Begriff "Geistiges Eigentum" ablehnt, so gilt auch für die Immaterialgüterrechte sicherlich folgende Norm entsprechend: "Eigentum verpflichtet. Sein Gebrauch soll zugleich dem Wohle der Allgemeinheit dienen." (Art. 14 Absatz 2 des Grundgesetzes)
Auch wenn es nicht so "sexy" ist: Statt radikaler Ansätze, "das Kind" revolutionär "mit dem Bade auszuschütten", erscheint mir ein reformerischer Ansatz in Bezug auf eine allgemeine Akzeptanz erfolgversprechender. Dies setzt allerdings eine lange und intensive Diskussion - auch von vielen Detailfragen - voraus.
Willi wird mir allerdings insoweit sicherlich nicht zustimmen.
Ich bin halt ein alter Mann, der die Erfahrung gemacht hat, dass es gar nicht so einfach ist, die Welt nachhaltig zu verbessern.

Insofern sind die tatsächlichen Gegebenheiten bei Computerprogrammen wesentlich anders, als bei anderen urheberrechtlich geschützten Werken.
Also gibt es ohne Urheberrecht kein Copyleft, was die Situation der Nutzer arg verschlechtert.

Stimmt, deshalb können viele nicht mit meiner Petition einverstanden sein! Deshalb habe ich als Software-Entwickler letzten Endes die BSD und nicht die GPL gewählt!
Ja, das ist der Punkt, wo ich aufhöre, mit Richard Stallmann einverstanden zu sein : ich habe im Gegensatz zu ihm nicht das Bedürfnis, andere daran zu hindern, mein Werk potentiell auch für Dinge zu benutzten, die mir nicht passen. Das ist Sache der anderen Benutzer und ggf die der Polizei. Aber ich als Autor fühle mich nicht verantwortlich für potentielle unmoralische Nutzung meiner Arbeit durch andere. Mir ist es egal, wenn es /auch/ unfreie Software gibt. Mein Problem ist, dass diese unmoralische Tätigkeit sogar noch vom Staat unterstützt wird.
Und ich finde auch nicht, dass die Situation der Nutzer arg verschlechtert wird, wenn sie nur eine kompilierte Variante eines ursprünglich freien Werks bekommen. Das ist wie mit der Wurst : Kein Endbenutzer einer Wurst will beim Konsumieren derselben wissen, wie die gemacht worden ist. Wenn alle relevanten Details über das Produzieren von Würsten bekannt wären, würden viele Leute Vegetarier. Bei Facebook ist das wahrscheinlich nicht anders.

ich lasse einmal Deine Antwort als Tofu stehen, weil dies dem besseren Verständnis dienen könnte..
1. Du vermengst unzulässigerweise zwei Probleme.
Keine Freie Lizenz schützt vor einer "unmoralischen" Nutzung der Software. im Gegenteil: Es ist absoluter Konsens, dass jede - auch noch so gut gemeinte - Einschränkung des "use for any purpose" eine Lizenz proprietär macht.
"Copyleft" will lediglich verhindern, dass von Freier Software abgeleitete Werke unter einer proprietären Lizenz verbreitet werden. Nicht mehr und nicht weniger!
Man kann über den Nutzen und die "Nebenwirkungen" von Copyleft - auch bezogen auf den Einzelfall - gut streiten, sollte diese Problematik aber nicht mit der vorgenannten vermengen, zu der eben eine sehr eindeutige und zwar ziemlich liberale Auffassung absolut vorherrschend ist.
Wer natürlich Copyleft ablehnt, hat unter diesen Aspekt auch keine Probleme mit der Abschaffung des Urheberrechts.
2. Es fördert nicht unbedingt die Wahrheitsfindung, Anwälten pauschal die Wahrnehmung eigener wirtschaftlicher Interessen zu unterstellen, wenn sie eine Meinung äußern.

Ach sorry für meinen dummen Witz. Natürlich sind wir uns einig, dass man den Autor einer Software nicht verantworlich machen kann, wenn sein Werk kriminell benutzt wird. Mit "unmoralisch" meinte ich lediglich "unfrei". Ich wollte darauf anspielen, dass die beiden Probleme eben doch auch gewisse Gemeinsamkeiten haben.
Und Punkt 2 unter Berücksichtigung des PS kann ich so stehen lassen. Danke für den Hinweis, ich versuche mich zu bessern, obwohl ich da offenbar ein Elefant im Porzellanladen bin, der beim nächsten Schwanzwedeln die nächste Vase runterfegen wird.

Das ist bei Software unter schützenden Lizenzen (GPL & Co.) nicht anders. Immer wieder gibt es Versuche, "freie" Lizenzen zu kreieren, bei denen Atomwaffentests, Tierversuche, Menschenhandel o.ä. ausgeschlossen werden sollen. Das passt nicht zusammen.
Mir ist es egal, wenn es auch unfreie Software gibt.

Das geht am Kern der Sache vorbei. Wenn mir die Wurst bei Metzger A nicht schmeckt (oder ich vermute, dass die Herstellung mir nicht passt), hole ich sie von Metzger B, kein Problem. Bei Software ist die Sachlage anders: Wenn ich mein Unternehmen von einer Software abhängig mache, bin ich auf Gedeih und Verderb darauf angewiesen, dass ich diese weiter beziehen kann. Es gab schon X erfolgreich vermarktete Programme, die dann plötzlich von Mitbewerbern aufgekauft und eingestellt worden sind. Bei Freier Software habe ich in diesem Fall immer noch die Möglichkeit, mich mit anderen Unternehmen zusammenzutun um diese weiter zu entwickeln. Bei proprietärer Software besteht diese Möglichkeit nicht.

Da Unternehmen, die ihr Wissen schützen möchten, dies weiterhin tun werden, würde dann die Patentschiene viel ausgiebiger gefahren werden. Ich zumindest möchte das nicht. Das soll nicht bedeuten, dass ich das Copyright-Wesen für ideal halte, aber man sollte sich über Konsequenzen von Alternativen klar sein.

Oh, das mit den Patenten war also wohl unklar in meinem Manifest. Jaja, auch Patente müssen meinem Vorschlag zufolge abgeschafft werden. Die sind ja letzten Endes auch nur das veröffentlichte geistige Resultat menschlicher Arbeit. Die technische Übernahme der Daten von einer proprietären Anwendung in die andere ist meistens viel einfacher als das Umschulen der Benutzer und die Inbetriebnahme einer neuen Umgebung. Dass wir von einzelnen Softwareanbietern abhängig werden, liegt weniger an der Tatsache dass es proprietäre Software ist als an der Tatsache, dass es Monopole sind. Stallman sagt ja eigentlich auch https://www.gnu.org/philosophy/not-ipr.html.en, dass geistiges Eigentum eine Illusion ist. Okay, in der Übergangsphase machte es Sinn, dieses etablierte Konzept auszunutzen, um Freie Software überhaupt möglich zu machen. Aber jetzt wo Freie Software ihre Machbarkeit und Nachträglichkeit bewiesen hat, wird immer klarer, dass ihr weiteres Wachstum vor allem durch die bestehenden Monopole behindert wird. Dass solche weltweiten Monopole entstehen konnten und kaum mehr kontrollierbar sind, liegt vor allem daran, dass geistiges Eigentum als Kapitalanlage genutzt werden kann. Deshalb ist m.E. das Konzept des geistigen Eigentums die Wurzel des Übels, während die Diskussion um Freie Software eher ein Symptom ist.

Die Möglichkeit den Quellcode und den ausführbaren Code zu trennen, sprich nur den Binärcode, nicht aber den Quellcode zu veröffentlichen ist ein wesentlicher Bestandteil dessen was eine Monopolbildung möglich macht.
Genau diese Möglichkeit würde aber ohne Urheberrecht weiter bestehen. Ja, man könnte die Software beliebig kopieren und bis zu einem gewissen Grad mittels Reverse Engineering versuchen Schlussfolgerungen auf den Quellcode zu ziehen. Die Abhängigkeit was die Weiterentwicklung, Korrektur von Fehlern und Sicherheitslücken und große Teilen des Supports angeht wäre aber mit oder ohne Urheberrecht ähnlich groß. Von daher glaube ich das man Freier Software einen Bärendienst erweisen würde, wenn man das Urheberrecht komplett abschaffen würde.
Ganz abgesehen davon denke ich dass das Urheberrecht durchaus positive Aspekte hat, z.B die Autorschaft. Das ich als Autor also ein Recht habe mit meinem Werk in Verbindung gebracht zu werden, auch wenn ich es als Freie Software oder unter einer Creative Commons Lizenz veröffentliche. Ich denke das ist ein wichtiges Mittel um sowohl eine Reputation aufzubauen als auch um Verantwortlichkeiten klar darzustellen.

ich adressiere im CC auch Luc, weil so frei die FSFde doch nicht ist, wie sie vorgibt. Er koennte dann einfach in einer antwort meine antwort weitergeben.
Nach wie vor stimme ich Luc zu, dass es nur um die konstruktion von "privatem geistigen Eigentum" geht. Unabhaengig von den konkreten ausformungen. Auch das "Markenrecht" ruht darauf.
Der hinweis von Michael Kesper ist voellig richtig, dass eine gewuenschte einschraenkung der anwendung notwendig erstmal einen privaten Besitzanspruch vorraussetzt, der ueber staatskonstrukte gewaehrt wird, um dann selektiv nutzungsrechte zu verteilen.

Da sollten wir aber schon genau hinsehen, wer alles zur autorenschaft gehoert. Und da bleibt fuer den jeweiligen "letzten autor" nicht mehr viel uebrig.
Ganz abschweifig wird es, wenn ich den text einer software trenne von seiner konkreten anwendung auf einer bestimmten ISA (Instruction Set Architecture). Das mag ja fuer manche wichtig sein, ist aber in diesem zusammenhang voellig irrelevant. Weil zur anwendung kommen die inneren strukturen und algorithmen, die im text enthalten sind und kein eigenleben fuehren. Und wer nun da alles zur autorenschaft gehoert, zeigt uns, wie wenig wir eigentlich dazu beitragen. Ausser vielleicht, von diesem und jenem etwas miteinander zu vermischen.
Und da unser text, auch Source Code oder Quellen Code genannt, sich immer auf eine allgemeine architektur der datenverarbeitung bezieht, um sie zu nutzen, dann sind ploetzlich alle die hiwi's schon von John Neumann, derer er sich bediente, auch teil. Und es findet kein ende.
Auf der resultatebene der symptome laesst sich nicht stabil aufsetzen. Deswegen wird auch so eine riesige propagandaschlacht um "geistiges Eigentum" gefuehrt. Waere es so eindeutig nachvollziehbar waere, gaebe es diesen aufwand nicht.
