Tun sie das? Ich meine, jeder kann seine eigenen Lizenzen schreiben und braucht dafür keine Erlaubnis der FSF oder OSI.
Aber bei einer Non-Commercial-Klausel wäre ich auch vorsichtig. Wenn ich heute Zeit investiere, um eine Bibliothek zu verstehen und in meinen Programmen zu benutzen, und in zehn Jahren kommt ein kommerzielles Projekt, in dem ich sie einsetzen möchte, und dann stellt sich heraus, dass der Autor nicht mehr erreichbar ist, oder er ist erreichbar und er will auch gegen Geld nicht von der Klausel abrücken ...
Für libraries sind Restriktionen wirklich ziemlich ungeeignet. Ich denke eher an Apps oder andere Dinge für Endverbraucher.
Ist es nicht sogar notwendig, dass man den eigenen Code gegen die Ausbeutung durch Tracking und Ads schützt? Und ist es nicht traurig, dass das nur durch proprietäre Lizenzen bzw. "Alle Rechte vorbehalten" geht? Warum unterstützt niemand im Softwarebereich einen brauchbaren Mittelweg wie bei CC-BY-NC?
(Die Haltung von FSF und OSI ist ziemlich eindeutig ablehnend, die Argumente treffen sicher häufig zu, aber keineswegs immer, und beide Organisationen beanspruchen für sich das Recht zu definieren, was "frei" ist und was nicht.)

CC-BY-NC sollte aber genau diese Form der Verwertung (im Nutzerauftrag) ermöglichen, d.h. als nicht-kommerzieller Käufer kann ich jemanden beauftragen, mir das Buch mit NC-Inhalt anzufertigen.
Das Bewerben einer solchen Dienstleistung wird aber kontrovers angesehen, obwohl sie m.E. vollständig im Einklang mit den ursprünglichen CC-Ideen steht.

Mit welchem Recht definieren diese Verbände, dass Freiheit in 4er-Gruppen aufzutreten hat? Die 0. Freiheit löst einen Freiheitskonflikt zwischen Nutzer und Programmierer zulasten der ethisch motivierten Programierer und zugunsten unethischer Nutzer. Freie Software und gutes Gewissen schließen sich nach den Regeln der FSF(E) aus. Ist das wirklich richtig?

die optimistischen Statements aus Deinem Vortrag teile ich nicht. Zwar sehe ich, dass im politischen Bereich freie Software durchaus Erfolge für den Bürger erzielt. Aber in der Wirtschaft ist freie Software auf breiter Front die Grundlage absolut unethischer Geschäftsmodelle. Der durchschnittliche Nutzer kommt mit freier Software nur über diese Geschäftsmodelle in Berührung. Tendenz steigend.
Eine proprietäre MS Office-Lizenz wie vor 10 Jahren war definitiv freiheitlicher als Office 365 heute, obwohl bei ersterem keine freie Software beteiligt war, bei letzterem vermutlich schon. Die FOSS-Bewegung hat - aus der Sicht des durchschnittlichen Nutzers! - nichts Freiheitliches bewirkt, im Gegenteil. (Für mich persönlich stellt sich das natürlich ganz anders dar, aber ich bin auch kein durchschnittlicher Nutzer.)
Dein Argument, man solle doch auf der Basis der "kleinsten gemeinsamen Schnittmenge" zusammenhalten, kann man ganz einfach auch umdrehen: Man verkleinert die Schnittmenge und vergrößert die Basis, indem man für Leute, die aus Gewissensgründen die Freiheit 0 nicht mittragen wollen, eine geeignete Lizenz vorhält - vergleichbar wie es CC mit NC tut.

Ich habe mir Matthias' Vortrag angeschaut und muss ihm zustimmen, dass Software-Lizenzen möglicherweise nicht der richtige Hebel für alle Arten von Weltverbesserung sind.
Bemerkenswert finde ich den von Antje eingeworfenen Ansatz, Softwarelizenzen nicht um konkrete politische Ziele zu erweitern, sondern abstraktere Zwischenziele einzubauen, auf die man sich leichter einigen kann.
Meine persönliche Erfahrung ist: Anfangs habe ich meine Projekte standardmäßig unter GPL gestellt. Dann musste ich mir aber eingestehen, dass ich die lange GPL noch nie im Ganzen gelesen habe, nur die Erklärungen der FSF dazu, und ich selbst die Tragweite der einzelnen Punkte eigentlich nicht abschätzen kann. Dann kam zur GPL-2 noch die GPL-3, mit der man die Tivoisierung verhindern wollte, und es wurde noch komplizierter. Deswegen nehme ich heute vorrangig die BSD-Lizenz.
Also es falls mal allgemein anerkannte Lizenzen geben sollte, die nichtkommerzielle Verwendung oder ethische Aspekte enthalten sollte, so besteht die Gefahr oder Chance, dass ich die schon deshalb nicht verwenden werde, weil ich die Tragweite der Regeln nicht abschätzen kann.
Bleibt die Frage, welche Wege neben Softwarelizenzen man zur Weltverbesserung beschreiten könnte oder sollte. Das kommt dann aber schon auf das Beispiel oder das konkrete Ziel an.
Wenn ich dein Beispiel mit MS Office aufgreife: Du sagst, dass aus Sicht des Normalnutzers freie Software für ihn nichts freiheitliches bewirkt hat, aus deiner Sicht (als Experten) jedoch schon. Wenn das so ist, wie kann man den Normalnutzer an deiner Expertensicht teilhaben lassen? Würde dies das Problem schon lösen? Das wäre möglicherweise einfacher zu haben, als eine neue Softwarelizenz.

Das wäre vermutlich am sinnvollsten. Aber bisher lehnt die FSF(E) jede Einschränkung von Freiheit 0 generell ab. Die mMn bisher überzeugendsten Vorschläge waren MIT bzw BSD plus 2 weitere Sätze mit der ethischen Einschränkung. GPL3 ist wirklich ein Monster. Aber bei konkreten Formulierungen bin ich noch gar nicht angekommen :-)
Wenn das so ist, wie kann man den Normalnutzer an deiner Expertensicht teilhaben lassen?
Da Ottilie Normalnutzer in absehbarer Zeit auf dem Desktop nur noch SAAS nutzen wird, sehe ich da keinen praktikablen Weg. Das ist die Realität, die bei FSF(E) noch nicht so richtig angekommen zu sein scheint. Beim Handy war "Free your Android" der richtige Ansatz, aber praktisch ist das für die meisten Leute nicht umsetzbar. Und auch da geht die Tendenz zu WebApps. Du weißt nie, was auf dem Server läuft, deshalb ist für Endanwender das ganze FOSS-Konzept passé.
Un der Entwickler weiß zwar, was auf dem Server läuft, aber nicht, wass das Endgerät macht, weil Google ab August das code-signing übernehmen will.

An dieser Symbolpolitik leidet unser Gemeinwesen. Die Bereitschaft zum Statement ersetzt den Einsatz für eine ursachenbeseitigende oder zumindest symptomlindernde Problembearbeitung.
Letzteres ist meist schwierig und anstrengend, ersteres billig.

Das Thema ist eine klassische Frage und in den letzten Jahrzehnten (Freie Software gibt es bewußt seid ungefähr 35 Jahren) immer wieder diskutiert worden.
Die praktischen und theoretischen Gründe kamen in dieser Diskussion ja ganz gut raus, warum die gesamte Freie Software Bewegung (mit FSF, FSFE, Debian, OSI und vielen anderen) das für die bisher beste Definition hält.
Trotzdem gibt es weitere Gefahren für die Freiheit der Menschen in Beziehung von Software-Nutzung. Nicht alle Gefahren lassen sich über die Lizenz gut regeln. Und ja, solche Überlegungen gibt es. Eine Wichtige ist: Den Macher:innen von Software und digitalen Diensten Geschäftsmodelle zu ermöglichen, welche die Freiheit und Privatspäre erhalten (und fördern).
Und die Überprüfung von Software und Diensten der "großen" Anbieter ermöglichen. https://www.kuketz-blog.de/unterstuetzen/ wird durch Lesende finanziert, um (unter Anderem) immer wieder zu schauen: Wo haben die Produkte Probleme? Welche Alternativen gibt es?

Ja das ist so richtig! Und zwar aus vielen unterschiedlichen Gründen.
Zunächst: Eine Regelung dergestalt, dass der Urheber Nutzungen ausnehmen darf, die ihm unethisch erscheinen, würde das Chaos der Copyleft-Lizenzen extrem vergrößern.
Eine Pflicht zum ethischen Verhalten bedeutet zugleich das Ende von Freiheit und Demokratie. Selbst über das "ethische Minimum" dürfte nämlich ein Konsens schwer zu finden sein.
Der Grundsatz „Handle nur nach derjenigen Maxime, durch die du zugleich wollen kannst, dass sie ein allgemeines Gesetz werde.“ bedeutet gerade nicht, dass alles, was jemand selbst nach langem Nachdenken für gut und richtig befindet, allgemeines Gesetz werden sollte, nach dem sich die anderen zu richten haben. Anders ausgedrückt: "Freiheit ist immer nur Freiheit des anders Denkenden. Nicht wegen des Fanatismus der ‚Gerechtigkeit‘, sondern weil all das Belehrende, Heilsame und Reinigende der politischen Freiheit an diesem Wesen hängt und seine Wirkung versagt, wenn die ‚Freiheit‘ zum Privilegium wird."
Weitere Argumente lassen sich finden.

Weniger, weil Geldverdienen an sich ein Problem ist, sondern, weil wir in einer Gesellschaft leben, in der letztlich alles ökonomischen Zwängen unterworfen ist (was wir selbst in Krisenzeiten, wie uns die letzten Monate zeigten, kaum in Frage stellen). Die Moral unserer Gesellschaft besteht also in erster Linie darin, dass wir niemandem einen Strick daraus drehen, Geld zu verdienen (unsere Gesellschaft dreht die Stricke eher für die "Bartlebys" da draußen). "NC" bekommt in diesem Zusammenhang meinem Eindruck nach oft "Knieschusscharakter", weil mir schon als juristischem Laien kaum noch transparent ist, wann heutzutage ein Veröffentlichungskontext als kommerziell gilt und wann nicht. Beispiel: Das "Open Source"-Portal der Berliner Zeitung sagt: "Optional haben Autoren die Möglichkeit, ihre Beiträge unter der Creative Commons Lizenz (CC BY-NC-ND 4.0) zur Verfügung zu stellen." (https://www.berliner-zeitung.de/opensource.102233). Das von einer kommerziellen Instanz formuliert finde ich schon absurd, es wird aber noch absurder, wenn die veröffentlichten Beiträge anschließend hinter einer Paywall liegen (was meinem Wissensstand der Fall ist).

mein Gedankengang startete bei CC-NC, aber von dieser Verengung bin ich im Laufe dieser Diskussion abgekommen. Roland, mir ist bewußt, dass es in der philosphischen Diskussion Unterschiede zwischen den Begriffen "Ethik" und "Moral" gibt, aber ich denke nicht, dass die Begrifflichkeit hier wichtig ist - die bisherige Diskussion zeigt, dass alle wissen, was mit "ethisch" hier gemeint ist.

Es ist jedem unbenommen, eine proprietäre Lizenz zu formulieren und durch seine Schöpfungen beispielsweise Milliardär zu werden.
Aber niemand kann gezwungen werden, eine Software-Lizenz als "frei" oder "Open-Source-Lizenz" anzuerkennen, wenn diese Lizenz seinen oder ihren Bedingungen nicht genügt. Und wenn "use for any purpose" eine dieser Bedingungen ist, dann muss ein Entwickler, der hier Einschränkungen vornehmen will, eben akzeptieren, dass seine Software von dieser Person nicht "frei" genannt wird.
Diese Meinungsfreiheit gilt sowohl für einzelne Personen als auch kollektiv (beispielsweise für die FSF, FSFE, OSI, Debian etc.).
Es ist auch nicht so, als hätten die Menschen, denen Softwarefreiheit ein Anliegen ist, nicht auf neue Herausforderungen reagiert (Nutzung von Software mittels Internet -> AGPL; Bedrohung durch Softwarepatente und "Tivoisierung" -> GPLv3 etc.; Erweiterung des OSI-Katalogs um eine 10. Bedingung).
Die angesprochenen ethischen Fragen sind aber oft uralt (Krieg und Frieden, Töten von Tieren des Verzehrs wegen etc.). Auch die Gefahren, die vom Technik ausgehen können, sind im Prinzip altbekannt (Missbrauch von Werkzeugen, "Dual Use", Schadens- und Zerstörungspotential bei Fehlern (daher wurde vor langer Zeit ein "Dampfkesselüberwachungsverein" gegründet), Zurechnung einer Schadenverursachung durch Gegenstände (Tiere, Maschinen, z. B. Kraftfahrzeuge, Gebäude etc. an Personen (Halter, Hüter, Eigentümer)).
Aus gutem Grunde wurden diese Fragen bisher in allgemeinen Gesetzen abgehandelt und nicht in individuell formulierten Lizenzen für einzelne urheberrechtlich geschützte Werke.
Wer übrigens tatsächlich gewillt ist, einen Angriffskrieg zu führen oder an einem Völkermord mitzuwirken, wird sich von der Verwirklichung seiner verbrecherischen Absichten kaum von den (zusätzlichen) Strafandrohungen oder finanziellen Ansprüchen des Urheberrechts abhalten lassen. Und das ethische, moralische oder rechtliche Urteil über einen Massenmörder wird wohl nicht wesentlich von einer tateinheitlich begangenen Urheberrechtsverletzung beeinflusst.
Wer mag, soll sich also mit anderen Menschen zusammentun und ein "Ethik-Siegel" für Software-Lizenzen kreieren. Nur soll nicht von mir oder anderen verlangt werden, solche Lizenzen gegen meine oder unsere Überzeugung als "frei" anzuerkennen.

"Eigentumsrechte" im Zusammenhang mit Urheberrechten und Lizenzen ist ein schwieriges "wording".
Die bisherige Linie der FSFE war, soweit ich sie verstanden habe, den Begriff "intellectual property" abzulehnen.
Zum Hintergrund:
Urheberrechte sind zwar "Eigentum" im Sinne des Artikel 14 des Grundgesetzes (für die Bundesrepublik Deutschland), aber kein (Sach-)Eigentum im Sinne der §§ 903 ff. des Bürgerlichen Gesetzbuches, welche jedoch die allgemeine Vorstellung vom "Eigentum" prägen.
Oder anders ausgedrückt: Ein Gedicht kann man nicht so zum "Eigentum" haben wie ein Kleidungs- oder Grundstück.
Umgekehrt gibt mir das "Eigentum" an einem Buch, einem Kopierer, Toner und Papier nicht unbedingt das Recht, das Buch zu kopieren und die Kopie zu veräußern.
Es gab Zeiten, da galt das Stehlen oder Unterschlagen eines Buches als verabscheuenswert, das Abschreiben desselben jedoch als ein edles Handeln.
Ich persönlich würde die Lizenz auch sogenannter "Freeware", die zwar kostenlos, z. T. auch "kommerziell" genutzt werden darf, als proprietär bezeichnen, weil dem Nutzer wichtige Rechte gerade nicht eingeräumt werden.

Da gibt es sicherlich mehr als nur eine Meinung dazu - und wer hat jetzt recht? (Bitte nicht hier weiter diskutieren - soll nur als Beispiel dienen!!!) Und wer verfolgt ggf. diesen vermeintlichen Urheberrechtsverstoß dann gerichtlich? usw, usf...
Mit welchem Recht definieren diese Verbände, dass Freiheit in 4er-Gruppen aufzutreten hat?
Mit demselben Recht, das jeder andere auch hat, der so was vorschlägt. Mach' doch einfach besser. Bzw.: Du musst die Lizenzen ja nicht verwenden. Es gibt halt nur gute Gründe dafür.

Hallo Liste,
um nochmal auf das alte Thema zurückzukommen - ich habe gerade ein ganz aktuelles Beispiel gefunden, wo die Programmierer:innen sich zu einer Lizenzeinschränkung gezwungen fühlten, meines Erachtens zu Recht: Eine "Consensual Use Restriction" für ein Tool zur forensic analysis (https://github.com/mvt-project/mvt). Ohnehin auch unter anderen Gesichtspunkten ein interessantes Projekt.
Auch hier könnte man sagen, dass "non-consensual use" eigentlich kein Fall für das Lizenzrecht, sondern ein Fall für das Strafrecht ist. Aber das Problem ist: Unser Strafrecht reicht nicht bis ins Ausland, z.B nicht in die USA - das Lizenzrecht aber sehr wohl. Insofern ist das Lizenzrecht international ein schärferes Schwert als das Strafrecht.
Deshalb ist eine Einschränkung, die eine befürchtete kriminelle Nutzung - durch Regierungen - ausschließt, sehr sinnvoll. Au meiner Sicht macht das die Software nicht unfrei, sondern freier.

dies ist wirklich ein altes Thema.
Wenn irgendetwas überall auf der Welt strafbar ist und der Täter oder die Täterin dennoch zur Tat schreitet, wird sie die (zusätzliche) Strafbarkeit eines Lizenzverstoßes wohl kaum aufhalten.
Dann ist eine entsprechende Einschränkung der Lizenz als präventive Maßnahme sinnlos und bloße "Symbolpolitik".
Wenn etwas nur in einigen Ländern strafbar ist, würden die Entwickler mit einer entsprechenden Einschränkung versuchen, die Wertvorstellungen ihres Landes oder ihrer Länder, die den jeweiligen Strafvorschriften zugrundeliegen, weltweit durchzusetzen.
Das mag man einerseits Chauvinismus nennen.
Andererseits ist es auch ein sehr ambitioniertes Unterfangen, denn der Verfolgungseifer der Behörden und Gerichte eines Landes, in dem andere Wertvorstellungen herrschen, sodass es dort eine entsprechende Strafvorschrift nicht gibt, in Bezug auf einen Urheberrechtsverstoß dürfte wohl nicht wirklich hoch sein.
Insoweit erweist sich das Urheberrecht aller Wahrscheinlichkeit nach als ein sehr stumpfes Schwert zur weltweiten Durchsetzung partikulärer Srafvorschriften.
Auch insoweit ist dann die Charakterisierung als bloße "Symbolpolitik" naheliegend.
Das Urheberrecht an Computerprogrammen als Zwangsmittel zur Hebung der allgemeinen Moral und zur Durchsetzung eigener ethischer Vorstellungen zu nutzen, erscheint mir aber nicht nur aus den genannten Gründen sinnlos, sondern auch mit den ethischen Vorstellungen, die Freier Software zugrunde liegen, unvereinbar.

Ich glaube nicht, dass man seine Vorstellungen von Ethik versucht, durchzusetzen und dass das eine Form von Chauvinismus ist.
Mich erinnern diese ethischen Klauseln in Softwarelizenzen eher an sowas wie GLS Gemeinschaftsbank oder Strom von den Bürgerwerken also in dem Fall Genossenschaften, die bei der Investition von Geld / Stromerzeugung auf die Ökobilanz / Nachhaltigkeit schauen und da strengeren ethischen Prinzipien folgen. Wem das nicht so wichtig ist, geht zu einer anderen Bank oder einem anderen Stromerzeuger, wer die ethischen Klauseln in der Lizenz nicht einhalten möchte, nutzt halt eine andere Software.
Der Vergleich passt jetzt nicht 1:1 aber zumindest haben die Lizenzinhaber das Recht, gegen Lizenzverstoß vorzugehen.
Ich sehe es aus der Sicht einer Entwicklerin: Es ist doch ein ehrenwertes Ziel, Software "für den guten Zweck" entwickeln zu wollen und bei proprietärer Software mag man vielleicht noch Kontrolle über den Anwendungsfall haben aber bei Open Source nicht mehr. Also wenn man z.B. Datenanalyse-Algorithmen entwickelt, kann das wichtig sein für Wissenschaft und Forschung aber in Bezug auf Überwachungstechnologien problematisch.
Da scheint mir ethische Lizenzen ein interessanter Gedanke.

die Diskussion wurde hier schon einmal vor nicht allzu langer Zeit geführt, daher ist es in meinen Augen vollkommen verständnis, dass die Beteilung diesmal nicht so hoch ist, denn die meisten werden nicht so motiviert sein, ihre Argumente immer wieder vorzutragen.
Davon abgesehen ist die Diskussion wirklich uralt. Sie ist so alt wie die ersten Freie-Software-Lizenzen, denn selbstverständlich gab es diese Ideen schon damals. "Gefährliche Algorithmen" und all das gibt es ja nicht erst seit Deep Learning, früher waren es halt andere Fortschritte, die vielen von uns Programmierern Bauchschmerzen bereiteten.
Ich persönlich finde die Idee hinter ethischen Klauseln in Softwarelizenzen übrigens trotz aller Probleme immer noch sehr reizvoll, sie hatte mich schon damals fasziniert, als ich das erste Mal davon hörte.
Von einem "schnellen Abschmettern" kann hier wirklich nicht die Rede sein, sondern eher von einer Zusammenfassung der Probleme, wie sie seit Jahrzehnten bestehen und an denen sich bis heute nichts wesentlich geändert hat. Die immer wieder als "neu" vorgetragenen Argumente sind bestenfalls alter Wein in neuen Schläuchen, sie sind hundertfach in verschiedensten Gruppen und Sprachen durchdekliniert worden.
Wenn dieses - wiegesagt durchaus sehr interessante! - Vorhaben zu irgendeinem Erfolg führen soll, kann das nur gelingen, wenn man zuallererst diese Probleme anerkannt, möglichst vollständig auflistet systematisch an Lösungen arbeitet. Und das ist sehr viel harte und zeitaufwändige Arbeit, von der nicht klar ist, ob das Ergebnis den Aufwand wert sein würde. An dieser Stelle ist es absolut kontraproduktiv, diese Probleme kleinzureden oder gar wegdiskutieren zu wollen.
Nehmen wir zum Beispiel das Problem, dass Ethik starken kulturellen Einflüssen unterliegt, und auch innerhalb einer Kultur zwischen Individuen abweicht. Hier bieten sich zwei Lösungsmöglichkeiten an, doch jede wäre mit sehr hohem Aufwand verbunden: Man könnte einen ethischen Grundkonsens erarbeiten, ähnlich der Deklaration der Menschenrechte. Oder man könnte verschiedene ethische Lizenzen koexistieren lassen, ähnlich wie Copyleft und Permissive Lizenzen nebeneinander existieren.
Ersteres würde ein sehr diverses internationales Team erfordern. Ich wüsste keine Person, in die die notwendige Anerkennung und Ausstrahlung in allen relevanten Kulturen und Subkulturen besitzt, um ein solches Team überhaupt zusammenzustellen und lange genug zusammenzuhalten. Selbst, wenn das gelänge, müsste immer noch ein Konsens erarbeitet werden, das ist das wahnsinnig großes Unterfangen. Und wie auch immer das Ergebnis aussähe, wäre nicht klar, ob ganz am Ende dieser Konsens aus substanziell mehr als dem bereits existierenden Konsens der 4 Grundfreiheiten bestehen würde.
Die zweitere Lösung wäre ein bewusst gewählter Wildwuchs an Lizenzen. Wer eine Software schreibt, die 10 Libraries mit unterschiedlichen ethischen Klauseln enthält, würde sie alle in seiner eignen Lizenz auflisten müssen. Der potentielle Nutzerkreis könnte durch die 10 Lizenzen bereits stark eingeschränkt ein. Jetzt kommt eine 11. Library hinzu. Kann ich in vertretbarer Zeit entscheiden, ob ich diese verwenden sollte oder nicht? Was, wenn die Nutzerschaft nun so stark eingeschränkt ist, dass sie ohnehin nur noch für drei Nutzer auf der Welt in Frage kommt? Und wie behält man den Überblick? Die meisten sind bereits mit den existierenden 5-10 Standardlizenzen überfordert, und das trotz existierender hervorragender Tools zur Code- und Lizenzanalyse. Zudem müsste man die ethischen Klauseln in irgendeiner Form vereinheitlichen in einer Art riesiger Checkliste. Diese Form der Standardisierung kann ewig dauern und viele freiwillige Helfer "verbrennen". Oder keine Checkliste, alles Prosa, doch dann können einem die Tools nicht mehr zuverlässig helfen, man bräuchte letztendlich eine Rechtsabteilung dafür. Dann könnten es sich praktisch nur noch große Unternehmen leisten, ethische Lizenzen einzusetzen.
Und das ist nur eines der vielen Probleme, die es zu beackern gäbe.
Ein anderes wäre die Durchsetzbarkeit: Welche ethischen Klauseln würden sich tatsächlich per Urheberrecht dank Handelsverträge effizienter durchsetzen lassen als z.B. die direkte Anwendung des Strafrechts? Und sind die Strafen via Urheberrecht empfindlich genug, und wenn nicht, würde eine lizenzverletzende Software dann wenigstens schneller vom Markt verschwinden? Wenn all das nicht gegeben ist, wäre eine solche Klausel es gar nicht wert, weitere ausgearbeitet zu werden. Und welche Klauseln würden in die Schranken des Urheberrechts fallen, und damit im Rahmen einer Softwarelizenz per se ungültig sein? Und diese Schranken sehen von Land zu Land verschieden aus, als fiktives Beispiel: Welchen Sinn hätte eine Anti-Atomkraft-Klausel, wenn sie nur in den Ländern durchsetzbar wäre, die sich ohnehin im Atomausstieg befinden?
Oder schreibt man trotzdem alle Klauseln in die Lizenz, egal wie unwirksam, einfach als symbolische Geste? Doch wie stellt man dann sicher, dass die Urheber im Fall eines Verstoßes das jeweils effizientere Recht anwenden? Wie stellt man sicher, dass sie nicht unwissenderweise zum falschen Zeitpunkt auf das Urheberrecht setzen und dann mit großem Aufwand eine "Strafe" erwirken, die die Gegenseite aus der Portokasse bezahlt?
Kurz: Auch hinter dem Problembereich "Durchsetzbarkeit" steht ein astronomischer Arbeitsaufwand, der zudem ein breit aufgestelltes Team von juristisch hinreichend qualifizierten Freiwilligen benötigt.
Und so weiter.
Befürworter von ethischen Klauseln in Softwarelizenzen kommen und gehen, und das seit Jahrzehnten. Aber, soweit ich weiß, hat sich niemand ernsthaft den Herausforderungen gestellt. Und das ist in keiner Weise abwertend gemeint, es ist einfach eine sehr harte Nuss.

Mich erinnern diese ethischen Klauseln in Softwarelizenzen eher an sowas wie GLS Gemeinschaftsbank oder Strom von den Bürgerwerken also in dem Fall Genossenschaften, die bei der Investition von Geld / Stromerzeugung auf die Ökobilanz / Nachhaltigkeit schauen und da strengeren ethischen Prinzipien folgen. Wem das nicht so wichtig ist, geht zu einer anderen Bank oder einem anderen Stromerzeuger, wer die ethischen Klauseln in der Lizenz nicht einhalten möchte, nutzt halt eine andere Software.
Der Vergleich passt jetzt nicht 1:1 aber zumindest haben die Lizenzinhaber das Recht, gegen Lizenzverstoß vorzugehen.
Ich sehe es aus der Sicht einer Entwicklerin: Es ist doch ein ehrenwertes Ziel, Software "für den guten Zweck" entwickeln zu wollen und bei proprietärer Software mag man vielleicht noch Kontrolle über den Anwendungsfall haben aber bei Open Source nicht mehr. Also wenn man z.B. Datenanalyse-Algorithmen entwickelt, kann das wichtig sein für Wissenschaft und Forschung aber in Bezug auf Überwachungstechnologien problematisch.
Da scheint mir ethische Lizenzen ein interessanter Gedanke.

es steht jedem Entwickler frei, in seine Lizenz hinein zu schreiben, was er will.
Er kann nur nicht verlangen, dass andere, beispielsweise ich, sein Werk "Freie Software" nennen, wenn die Lizenz das Recht "use for any purpose" einschränkt.
Und selbst wenn die OSI seiner Lizenz dennoch das Zertifikt "Open Source" verleihen würde, würde ich daran festhalten. "Open Source" und "Freie Software" wären dann eben nicht mehr synonym (was schade wäre).
Mir persönlich scheint eine solche "ethische" Einschränkung auch zwar gut gemeint, aber nutzlos, denn z. B. Überwachungswillige - beispielsweise Geheimdienste in Diktaturen - wird man mit einer solchen Klausel in der Lizenz kaum beeindrucken können.
Übrigens bin ich sehr dafür, dass Menschen ihr Verhalten an ethischen Kriterien orientieren, auch wenn man über den Inhalt dieser Kriterien durchaus - auch seriös - diskutieren kann.

Aber dann scheitert es an unvereinbaren Haltungen zu Schule und Schulpflicht.
Das war jetzt etwas vereinfacht und zugespitzt, aber im Grunde sehe ich die Tendenz, Weltverbesserungsprojekte mit zuvielen Ansprüchen zu überfrachten, über die die Gruppe keine Einigkeit mehr erzielen kann. Wenn man 10 politische Themen nimmt, die sich mit einem Dafür und Dagegen besetzen lassen, dann gibt es 2^10 = 1024 Variationen (im Sinne der Kombinatorik). Das bietet Potential für 1024 dogmatische Gruppen, die alle nicht miteinander arbeiten können.
Es gibt ja jetzt schon eine unüberschaubare Menge an Software-Lizenzen. Zum Glück lassen sich viele immer noch miteinander kombinieren. Ich fände es gut, wenn es dabei bliebe.

das ist sehr bedauerlich.
Auch wenn es etwas vom Thema wegführt: Wichtig erscheint mir in seine ethische Orientierung auch Respekt und Toleranz aufzunehmen.
(Klar gibt es Grenzen der Toleranz, aber Respektlosigkeit ist niemals gerechtfertigt.)
Ich muss bereit sein auch Menschen zu respektieren, deren Wertesystem und Verhalten ich ablehne (möglicherweise auch mit guten Gründen ablehne).
Und ich muss auch bereit sein, mit ihnen zusammenzuarbeiten, solange ich hierfür nicht ihr Wertesystem und ihr Verhalten übernehmen muss, sie also auch mir gegenüber tolerant sind.
Ich muss es aushalten können, dass mein Wertesystem nicht das "einzig wahre" ist, sondern hierfragt und sogar abgelehnt wird, was mich zwingt, es immer wieder neu zu hinterfragen und zu begründen.
Nur die Bereitschaft jedes Einzelnen hierzu kann eine Fragmentierung der Gesellschaft verhindern.
Ich denke, dass diese Haltung gerade auch für Freie-Software-Aktivisten wichtig ist (und damit hier on topic ist). Ich muss es aushalten, dass ich mit Menschen zusammenarbeite, für die Freie Software ein "Geschäftsmodell" ist, wie ich es auch aushalten muss, mit Menschen zusammenzuarbeiten, für die Freie Software der erwünschte "Weg des 21. Jahrhunderts zum Kommunismus" ist.

Denen fehlt es an Vorwissen, um dort tiefer einsteigen zu können, und denen fehlt es an Zeit, das zu tun (weil sie die wenige Zeit, die sie haben, für ihre Kernanliegen investieren wollen). Das ist leider nicht nur dort so.
Konsequenz: Es gibt einen Haufen von Aktivistengruppen, die allesamt innerhalb ihres kleinen Mikrokosmos versuchen, ein paar sicher richtige Dinge zu adressieren, die allesamt zahlenmäßig aber viel zu unbedeutend sind, irgendetwas zu bewirken, und die sich im schlimmsten Fall noch gegenseitig bekämpfen, weil sie die Prioritäten des jeweils anderen kleinreden und wegdiskutieren wollen. Keine Idee, wie man das auf größerer Ebene einfangen kann, aber Bereitschaft und Willen des Einzelnen, sich überhaupt erstmal damit zu beschäftigen, andere Werte zuzulassen, die eigenen zu hinterfragen und im Zweifelsfall das Einende (statt das Teilende) zu suchen, scheinen als Grundsatz nicht falsch.

danke, ich werd's mal versuchen. Die Grund-Herausforderung, die ich dort immer wieder erlebe, ist analog zu anderen digitalen Themen: Die "Lücke", die es zu überwinden gilt, ist viel zu groß. Das sind oft(?) Menschen, die hier zwei Meilen weit zurück sind und denen Zeit, Interesse fehlt, erstmal die Voraussetzungen dafür zu haben, "Digitales" überhaupt als für Nachhaltigkeit relevantes Thema wahrzunehmen. Das ist vermutlich weit weniger offensichtlich, ales es das für uns scheint...

Sehr spannende Diskussion!
Die "Nachhaltigkeits-Aktivisti" für nachhaltige Digitalisierung zu sensibilisieren ist ein Kernanliegen der Bits&Bäume-Bewegung [1].
Meine These dazu: Wenn wir diese Zielgruppe bisher schlecht erreichen, dann müssen wir besser (d.h. überzeugender) werden, die Relevanz unserer Themen herauszustellen.
Ein paar Ansätze:
"Datensammeln -> Gezielte Werbung -> Mehr Konsum -> Ressourcenverbrauch -> Umweltzerstörung"
"Kritik des konra-nachaltigen Konsumkapitalismus auf Instagram ist wie ein EndeGelände Plenum im Tankstellenbistro." (pointiert in Rechtfertigungsposition bringen und damit das Thema setzen)
Freie Software ermöglicht erhebliche Nutzungsdauerverlängerungen von alter Hardware. -> Ressourcenschonung.
Umweltbeirat der Bundesregierung (2019): "Digitalisierung ist heute Brandbeschleuniger für Ressourcen-Raubbau und Ungleichheit" [2]
Engagement für Umweltschutz ist oft oppositionelles politisches Engagement. Tracking und Überwachung sind somit konkret gefährlich. Freie Software, und allgemein digitale Kompetenz sind essentiell.

Definitiv bedarf es auch eine zielgruppenspezifische Ansprache. In meiner Wahrnehmung unterschätzen viele Befürworter:innen von Freier Software wie weit vorn man manche (grundlegend aufgeschlossenen) Menschen abholen muss, sowohl sprachlich als auch thematisch. Das heißt auch ehrliches Verständnis für fehlendes Vorwissen haben und Details, die man selber spannend findet erstmal zugunsten der Verständlichkeit erstmal weglassen.
Was auch ein möglicher Ansatzpunkt ist: "Aufmerksamkeitstausch". Auch die anderen Weltverbesserungsgruppen haben das Problem, dass ihre wichtigen Botschaften zu wenig Aufmerksamkeit bekommen. Hier könnte man einen Deal machen: Wir organisieren einen gemeinsamen Info-Abend, unsere Tech-Blase hört 30 min Euch zu, dann hört Ihr uns 30 min zu und anschließend gibt es noch Zeit für allgemeinen Austausch und Fragen.
Wir – als Bits&Bäume-Bewegung – sind mit diesem Ziel zugegebenermaßen auch noch nicht übermäßig erfolgreich, aber wir arbeiten dran. Unterstützung und konstruktive Kritik willkommen. In diesem Zusammenhang erwähnenswert: am 02.09. gibt es das nächste größere Community-Treffen [3], wo dieses Thema super hinpassen würde.

Wie gut das in der Praxis funktioniert steht auf einem anderen Blatt, aber ich sehe hier das Problem nicht so stark, dass sich Leute ausschließlich für ihr Kernthema interessieren.

Mein Plädoyer für eine prinzipielle Wertschätzung parteipolitischen Engagements ist aber davon unabhängig.

ich wünsche Dir viel Erfolg und einen seeeehr laaangen Atem.
Anderen Gruppen würde ich eher empfehlen, zu versuchen, eine etablierte kleinere Partei lokal zu übernehmen. Immer wieder gern versucht: die FDP. Aber je nach Ort und Weltanschauung könnte sich grad auch Die Linke eignen.

um nochmal auf das alte Thema zurückzukommen - ich habe gerade ein ganz aktuelles Beispiel gefunden, wo die Programmierer:innen sich zu einer Lizenzeinschränkung gezwungen fühlten, meines Erachtens zu Recht: Eine "Consensual Use Restriction" für ein Tool zur forensic analysis (https://github.com/mvt-project/mvt). Ohnehin auch unter anderen Gesichtspunkten ein interessantes Projekt.
Diese Lizenz ergibt doch gerade für solche Software keinen Sinn. Der Anwender will sie dazu nutzen, Daten zu ermitteln, deren Urheber garantiert nicht der Offenlegung zugestimmt hat.
