Tämä ei ole "virallinen" vastaus, jos vaikka olen ymmärtänyt jotain väärin, mutta alla nopeasti kyhätty näkemykseni asiasta (ja en ole asianajaja :)
Olen kyllä asianajaja, mutta munkin vastaus on yleinen. Se kuitenkin poikkeaa joltain osin Antin analyysista/tarkentaa sitä.
Suomessa eräs valtion laitos on julkaissut graafisen käyttöliittymän, jonka avulla käytetään Phil Harveyn julkaisemaa ExifTool ohjelmaa (http://www.sno.phy.queensu.ca/~phil/exiftool/). Harveyn ExifToolia käytetään komentotulkin avulla ja se on julkaistu Perlin lisenssiehdoilla.
Perlillä on kaksoislisensointi: http://dev.perl.org/licenses/
ExifTool pitäisi ladata erikseen ja katsoa sen lisensiointi myös paketista sisältä (juuresta ja jos huolellisesti toimitaan, niin myös faileista). Katsoin exiftoolin sivuja ja siellä sanottiin kohtuullisen hyvin, että työkalu on julkaistu samalla lisenssillä kuin perl ja viitattiin järkevästi perlin lisensiointisivuun.
Perlin kaksoislisensiointi tarkoittaa tässä varsin selvästi sitä, että myös Exiftooliin sovelletaan kaksoislisensiointia. Exiftoolin lataaja saa valita, soveltaako GPL:ää vai Artisticia.

Jos valitaan Artistic License, niin silloin se ei ainakaan aseta ehtoja kysyjän mainitseman GUI:n lisenssille. Kysyjän tarkoittama laitos voi valita, julkistaako se GUI:n suljetulla, avoimella tai jollain muulla lisenssillä.
Kätevintä on usein pitää jakelussa mukana alkuperäistä ExifToolia muuttamattomana Artistic-lisenssin alla. Muutettu versio (sisältäen muokkaukset ja GUI) voi sitten asettaa muita ehtoja, esim. kiellon jaella edelleen.
Noin teknisesti kiellon tulee silloin koskettaa muokkauksia ja GUI:ta (ei Exiftoolia), mutta muutettuun kokonaisuuteen sovellettuna niitäkin pitää noudattaa kokonaisuutta jaeltaessa.
GPL on selkeä siitä että käyttäjällä on oikeus levittää ohjelmaa eikä alkuperäinen tekijä voi tätä rajoittaa. "Artistic License" on OSI sertifioitu, ja antaa myös oikeuden levittää alkuperäistyötä ilman rajoituksia, kunhan tietyt vaatimukset täyttyvät.
Huomiona, että GPL:n asettaa alkuperäinen tekijä, ja tämä voi toki poiketa siitä haluamallaan tavalla; myöhemmät vastaanottajat - ns. downstream - ei voi enää näin tehdä, jos kyseessä on puhtaasti GPL-lisensioitu softa. Nyt vastaanottajat ovat kuitenkin voineet valita käyttää Artistic-lisenssiä.
Nyt kyselen, onko tämä edelleenjakelemisen kielto ristiriidassa avoimen Perl lisenssin kanssa? Entä mitä tietoja laitoksen pitäisi antaa ohjelmapaketin mukana, jos ExifTool jaellaan muuntelemattomana, tai jos sitä on muunneltu vain vähän.
Kielto on ristiriidassa ja lisenssin vastainen jos alkuperäinen työ on lisensoitu "Perl-tyylisesti". Lopullisesti tämän voi vain tarkistaa kyseisen paketin lisenssiehdoista.
En katsellut lainkaan, miten laitos ohjelman lisensioi tai miten em. kielto on kommunikoitu. En myöskään tutkinut mihin osaan kokonaisuutta (Exiftool, muokkaukset, GUI sekä mahdollinen tekijänoikeudellinen kokonaisuus) kielto laitoksen näkökulmasta kohdistuu.
Ainakin laitos voisi tehdä seuraavasti ja se olisi yhtenevä perl-lisensioinin kanssa: laitos asettaa ehtoja Exiftoolin muokkauksille ja GUI:lle. Mikäli samalla syntyy tekijänoikeudellinen kokonaisuus, voisi ehtoja asettaa myös kokonaisuudelle.
Lisäksihän tuossa on erilaisia käytännöllisiä toimenpiteitä, mm. muutosten merkitsemisessä ja muuttamattoman Exiftoolin saatavilla pitämisessä.
