So unsinnig ist es nicht. Ok, das Attribut "überflüssig" ist eine Übertreibung. Aber die Problematisierung des Copyrights durch RMS ist schon sehr deutlich. RMS' Ausgangsfrage ist nämlich: Welchen Zweck hat das Copyright? - und antwortet so: "So this also thought of as a bargain between the public and authors; that the public gives up its natural right to make copies of anything in exchange for the progress that is brought about indirectly, by encouraging more people to write."
Und heute funktioniert das "Abkommen" mit den langen Laufzeiten eben nicht mehr. Deswegen plädiert er für drastisch kürzere Laufzeiten (Filme 20 J., Bücher 10 J, Software 3 J.). Da ist der Unterschied zu mir (0 Jahre) nicht mehr so groß. Ich bin halt der Meinung, dass der Zweck für den Einzelnen und der Progress für alle viel besser ohne Copyright erreicht werden kann. Das ist ja gerade der subversive Sinn und die Wirkung der GPL (basiert auf dem Copyright, setzt seinen "Sinn" ausser Kraft).

Oder du bezeichnest die Software vor der großen Propretarisierungs-Wende Anfang der Achtziger nicht als "frei" - was ich auch hin- und wieder aus "didaktischen" Gründen tue: ohne unfreie Software keine freie Software. Das Urheberrecht war für die Tatsache der Freiheit damals bedeutungslos, sozusagen "neutral".

Das stimmt genauso wenig: Die Freiheit funktionierte früher auch ohne Copyleft. Ich ziehe für heute den Schluss daraus: Es muss auch nicht immer so sein wie es ist. Copyleft ist eine Art Notwehr-Freiheit, und das ist ok. Es geht aber auch grundsätzlich anders. Und wenn RMS über drei Jahre "Schutz"-Frist für das Copyright nachdenkt, dann geht das in die richtige Richtung, nämlich in die auf Abschaffung des Urheberrechts. Dass man es nicht "einfach so" abschaffen kann, ist mir klar. Ich bin nur immer wieder erstaunt über die Verweigerung, darüber überhaupt nachdenken zu wollen. Ein Tabu.

Ich meine: es macht Sinn. Praktisch wird das Urheberrecht sowieso zunehmend außer Funktion gesetzt (das Stichwort der sog. "Raubkopien"). Die Kritik die kommt, geht ja meist in eine völlig andere Richtung - nämlich die der Verschärfung und Sanktionierung. Und da gilt es auf der Seite der Freiheit zu stehen, und dass kann man konsequent eigentlich nur, in dem man die ganze antiquierte Urheberrechtslogik in Frage stellt.

Diese Aussage hilft nicht weiter. Nur weil ehedem Software (faktisch) ohne Restriktionen zusammen mit der Hardware vertrieben wurde, war sie noch nicht frei. Software wurde auch nicht wegen des Urheberrechts unfrei, sondern weil es als Wirtschaftsgut entdeckt wurde (neben der Hardware) und damit die Versuchung bestand, Software rechtlich und technisch unzugänglich zu machen.

Auch hier: Die Aussage hilft nicht weiter. Nur weil damals der Sourcecode freiwillig mitgeliefert wurde, würde eine "Abschaffung des Urheberrechts" diesen Zustand nicht wieder herbeiführen. Damals wurde der Sourcecode doch deswegen mitgeliefert, weil die Hardware als das Wirtschaftsgut angesehen wurde und man Soft- und Hardware nicht als getrennte Güter ansah. Der Freiheitsaspekt spielte dabei überhaupt keine Rolle, allenfalls aus pragmatischen Gründen wurden Änderungen der Software ermöglicht.

Es muss in der Tat nicht immer so sein, wie es ist ;-) Es wird aber auch nicht mehr wie es war.

Hier kann ich der Logik nicht folgen. Wie soll es "grundsätzlich anders gehen"? Wie soll jemand gezwunden werden, seinen Sourcecode herauszugeben, wenn er sich weigert? Es muss das rechtliche Verbot (Urheberrecht) vom technischen Verbot (Sourcecode schließen) unterschieden werden. Was hilft die rechtliche Freiheit, wenn die technische Freiheit fehlt? Freiheit muss auch wahrnehmbar und im Notfall erzwingbar sein - sonst ist sie wertlos. Deswegen sind Copyleft-Lizenzen wie die GPL in diesem Punkt auch wesentlich "strenger" als BSD-Lizenzen u.ä.

Diese Aussage verstehe ich leider nicht.

Wieso das denn? Das ist weder richtig noch dient das der Diskussion.

Das ist schlicht falsch. Außerdem zeigt u.a. das oben genannte Beispiel, dass die Raubkopierproblematik nichts mit der Sicherung von Freiheit zu tun hat.

Aber wieso daraus die Abschaffung folgern? Die Abschaffung des Urheberrechts fordern, heißt nicht an der "Seite der Freiheit stehen".

Das ifrOSS benutzt kein Outlook, aber ich - weil ich in meinem Büro sitze und dort Outlook verwendet wird. Im Übrigen bin ich der Meinung, dass es jedem freisteht, ob er schlechte oder gute oder bequeme oder Freie Software benutzt oder nicht. Auch das ist Freiheit.
Ich kann weiterhin nicht erkennen, warum die Abschaffung des Urheberrechts freiheitsdienlich sein soll. Diejenigen, die Ihre Werke freigeben wollen, können dies tun und werden urheberrechtlich darin geschützt. Die GPL erhält nur die Kraft, die sie auszeichnet, weil Sie durch das Urheberrecht ihre Durchsetzungsfähigkeit erlangt.
