ich machte mir schon häufiger Gedanken, wie es eigentlich mit der Gültigkeit und Kompatibilität von bestimmten Lizenzen in Deutschland aussieht. Ich habe halt den Eindruck, dass es viel Unsicherheit und Halbwissen gibt, was die tatsächliche Rechtsprechung in Deutschland angeht, und was darum alles möglich ist (welche Rechtsprechung ist im Endeffekt gültig?) [2]. Eigentliches Problem ist, dass so ziemlich alle Texte, die ich finde, sich auf amerikanische Rechtsprechung beziehen [0], aber es ja schon deutliche Unterschiede gibt - z.B. bei Public Domain [1].
Gibt es dazu schon Artikel, die das gut zusammenfassen, wurden dazu schonmal Informationen gesammelt? Oder wäre es möglich und gäbe es Interesse, im Rahmen der FSFE sowas zusammenzustellen und zu veröffentlichen? Europäischer Rahmen wär dann evtl. die nächste Stufe, aber erstmal klein anfangen...

2. Ich will eine Software veröffentlichen, ohne mich darum kümmern zu müssen. Selbst BSD wäre mit zu restriktiv in dem Moment. Was kann ich da nehmen, was auch in Deutschland sinnvoll gültig ist?

Es gibt bereits ein paar Bücher zum Thema "freie Lizenzen in Deutschland", teilweise wird darin auch die "tatsächliche Rechtsprechung" bzw. das, was die Autoren dafür halten, berücksichtigt.
Je mehr Bücher man liest, desto mehr Interpretationen der Rechtsprechung lernt man kennen ...

Rhetorische Frage: Gehst Du ernsthaft davon aus, dass die beitragenden Personen die Lizenzen lesen, verstehen und ihre Werke unter den Lizenzen verbreiten wollen werden?

Eine vergleichsweise liberale Lizenz ist die WTFPL: http://www.wtfpl.net/
Ob die Verwendung sinnvoll ist, ist Ansichtssache. Urteile mit Bezug zur Lizenz sind mir nicht bekannt.
Alternativ könntest Du alle (ohne Freitod und 70 Jahre Wartezeit) aufgebbaren Rechte aufgeben (CC-0).
