Diese Ausgabe berichtet über neue Entwicklungen bei Richtlinien zu Offenen Standards, ein paar grundlegende Informationen über Softwarepatente, Neuigkeiten von der FSCONS zu verteiltem Rechnen und wie Sie uns am Jahresende unterstützen können.
Diesen Monat hatten wir zum ersten Mal in der Geschichte der FSFE gleichzeitig Ausstellungsstände auf drei Konferenzen: dem [1]Brandenburger Linux-Infotag (BLIT) in Potsdam, der [2]Free Society Conference and Nordic Summit (FSCONS) in Göteborg/Schweden und der [3]T-DOSE Eindhoven/Niederlande. Unsere [4]PDFreaders-Kampagne ist ziemlich erfolgreich: 31 öffentliche Verwaltungen haben bereits Werbung für unfreie PDF-Betrachter von ihren Webseiten entfernt, acht von ihnen haben Links zu pdfreaders.org hinzugefügt. Die Systemadministratoren der FSFE haben die [5]Fellowship-Blog-Software aktualisiert und wir hielten mehrere Präsentationen vor Politikern, Parteien und der Berlin Debating Union. Im Rahmen eines [6]Fellowship-Interviews sprachen wir diesen Monat mit Brian über freie Dokumentation, den Emacs-Org-Mode und sein Verständnis von Software als ein Werkzeug. Zuletzt möchten wir Bjarni Rúnar Einarsson gratulieren, einem isländischen Freie-Software-Entwickler, der am Aufbau der Gemeinschaft gearbeitet hat und mit dem [7]Nordic Free Software Award ausgezeichnet wurde.
== Offene Standards: Indien – Europa 1:0 ==
Diesen Monat veröffentlichte die indische Regierung [8]ihre Richtlinie zu Offenen Standards, die einen großen Erfolg für die Freie-Software-Bewegung darstellt. Die daraus hervorgehenden Vorteile für Freie Software in Indien waren den dreijährigen Kampf mit den proprietären Softwareunternehmen definitiv wert. Wenn Sie die Dokumente der Regierung lesen, werden Sie [9]mehrere Punkte erkennen, die in [10]unsere Definition Offener Standards aufgenommen wurden, insbesondere die, über die wir bereits in der [11]Oktober-Ausgabe des Newsletters berichteten: Das Patente auf Standards kostenlos zur Verfügung stehen sollten. Diese Richtlinie wird die Innovation im indischen IT-Markt fördern, sie wird zu geringeren Kosten für die öffentliche Verwaltung führen und es Programmierern ermöglichen, innovativer zu sein.
Auch die Europäische Kommission nimmt eine Reform des europäischen Standardisierungssystems in Angriff. Zur Zeit wird die Standardisierung in Europa von einer kleinen Anzahl von Organisationen, hauptsächlich von Großunternehmen, dominiert. Gleichzeitig geschehen viele Innovationen in kleinen und mittleren Unternehmen. Obwohl zahlreich, haben sie nicht wirklich eine Mitsprache bei der Standardisierung. Wenn sich die Gelegenheit zur Teilnahme bietet, kämpfen sie oft mit einem Mangel an Zeit, Geld oder Fachwissen. Während das indische Dokument [12]von Revsion zu Revision besser wurde, wurde das [13]European Interoperability Framework (EIF) nur schlechter. Aber mit Ihrer anhaltenden Unterstützung können wir der Europäischen Kommission und den Mitgliedstaaten [14]weiterhin die Wichtigkeit Offener Standards erklären, so dass wir die selben Vorteile bekommen wie in Indien. Diesen Monat nahmen wir dazu an einer gemeinsamen [15]Veranstaltung der Europäischen Kommission und des Europäischen Patentamts teil.
== Softwarepatente: Kein weiteres Monopol auf Software ==
Ein weiteres Thema, das wir auf dem Treffen mit der Europäischen Kommission und [16]in einem Radiointerview hervorhoben, waren Softwarepatente.
Zuallererst einmal ist ein Patent ein Monopol auf eine Idee, während das Urheberrecht ein Monopol auf eine konkrete Implementierung ist. Beethovens Zweite Symphonie ist vom Urheberrecht abgedeckt, ein Patent hingegen würde zum Beispiel ein Monopol auf die Idee erteilen, Streichinstrumente mit Blasinstrumenten zu kombinieren. Software fällt unter das Urheberrecht. Dies ist sinnvoll: Bei Software haben Sie [17]geringe Forschungskosten, müssen aber viel Zeit für die Implementierung der Ideen aufwenden, um sicherzustellen, dass sie keine Sicherheitslücken hat und in Zukunft leicht zu warten und anzupassen ist. Es ist keine große Herausforderung, auf die Idee zu kommen, Streichinstrumente mit Blasinstrumenten zu kombinieren, die Herausforderung besteht darin, sie so zu kombinieren, dass das Ergebnis auch gut klingt.
Immer mehr Leute verstehen, dass [18]Softwarepatente für alle ein Problem darstellen, egal ob für Groß- oder Kleinunternehmen, für einzelne Softwareentwickler, für Benutzer, für unfreie oder für Freie Software.
- Die Unternehmen müssen mehr Geld für ihre Rechtsabteilungen ausgeben um Patente anzumelden, Kreuzlizenzierungen von Patenten auszuhandeln und sich gegen Patentklagen zu verteidigen. Während Softwarepatente für eine Weile ein nettes Mittel für Großunternehmen sind, um sich Konkurrenz durch Neueinsteiger vom Leib zu halten, so müssen sie sich auch mit Unternehmen auseinandersetzen, die andere wegen Softwarepatenten verklagen, selber aber keinerlei eigene Softwareentwicklung betreiben. Gegen solche Unternehmen kann jedes Softwareunternehmen nur verlieren. - Für Softwareentwickler bedeuten Patente eine rechtliche Unsicherheit: Sobald Sie anfangen zu programmieren, könnten Sie ein Gesetz verletzen. Sie werden nie in der Lage sein herauszufinden, ob Sie ein Patent verletzen. Selbst wenn Sie ein Softwarepatent lesen, kann es sein, dass es Ihnen nicht klar ist, ob es das abdeckt, was Sie gerade implementieren. Für die Registrierung eines Patents müssen wir Geld bezahlen. Anders beim Urheberrecht: Jeder von uns kann ein Programm schreiben, und sei es nur als Hobby, und dieses fällt anschließend ohne zusätzliche Kosten unter das Urheberrecht. Es ist sogar so, dass Softwarepatente uns enteignen können, da sie verhindern können, dass wir die Rechte ausüben, die wir durch das Urheberrecht bekommen, zum Beispiel das Programm an andere zu verteilen. - Die Benutzer müssten für all diese Kosten bezahlen. Manche Leute schätzen, dass die Patentkosten bei Smartphones ungefähr 20% des vom Kunden bezahlten Preises ausmachen.
Wir werden uns weiterhin bemühen, dieses Problem loszuwerden. In den USA arbeitet unsere Schwesterorganisation daran, [19]die öffentliche Aufmerksamkeit auf den durch Softwarepatente verursachten Schaden zu lenken und in Neuseeland hat die Regierung das Problem verstanden und sich [20]im April dafür ausgesprochen, Computerprogramme in die Gruppe der nicht patentierbaren Erfindungen aufzunehmen. In Europa hat der Gesetzgeber entschieden, dass Software nicht patentierbar ist. Aber Gesetze werden immer von Menschen interpretiert und in diesem Fall existieren unterschiedliche Interpretationen des Gesetzes. So erteilt das Europäische Patentamt (EPO) Softwarepatente, indem es sie zu "computerimplementierten Erfindungen" erklärt. Wir werden weiterhin gemeinsam mit unseren [21]Schwesterorganisationen, unserer [22]assoziierten Organisation FFII und anderen daran arbeiten, die Menschen über die Gefahren von Softwarepatenten zu informieren. Wir werden den Gesetzgebern erklären, dass sie die Gesetze präzisieren müssen, damit die Patentämter so handeln, wie es beabsichtigt war.
== Verteiltes Rechnen auf der FSCONS ==
Wir wissen, dass verteiltes Rechnen kein brandneues Thema ist. Es gibt sogar einen 7:21 Minuten langen [23]Werbefilm aus dem Jahr 1959 darüber und ein paar von jenen Ideen könnten immer noch in unserer heutige Diskussion über „Cloud-Computing“ relevant sein.
Unser Beitrag dazu war die Veranstaltung einer Vortragsreihe auf der diesjährigen FSCONS mit dem Namen [24]Divide and Reconquer (Teile und erobere zurück), die das Problem des Trends hin zu zentralisierten unfreien Internetdiensten und mögliche Lösungen dafür in den Fokus stellte. Dank der [25]Arbeit von Sam und unserer Vortragenden liefen alle fünf Vorträge gut und alle hatten ausführliche Diskussionen in den anschließenden Fragerunden zur Folge.
Zum Beispiel sagte [26]Brian Gough, der diesen Monat im Fellowship-Interview interviewt wurde, im Anschluss an die Demonstration der [27]Peer-to-Peer-Suchmaschine Yacy durch Michael Christen zu mir, dass er bis Ende nächsten Jahres nur noch verteilte Suchmaschinen für seine Suchen im Web benutzen will. Klingt nach einem guten Vorsatz fürs neue Jahr. Wie werden weiterhin an diesem Thema arbeiten und mehr Leute dazu animieren, darüber nachzudenken, mit anderen zu diskutieren und an Lösungen zu arbeiten.

Patente werden *nicht* auf Ideen erteilt! Patentieren kann man nur *Erfindungen*. Eine Idee kann jeder haben; das erfordert keine Investition. Eine nutzbare Erfindung erfordert hingegen Entwicklungsarbeit -- und diese ist es, was ein Patent entlohnen soll. Das eigentliche Problem ist genau die Aufweichung des Begriffs "Erfindung" -- bis so weit, dass bei den allermeisten Softwarepatenten die schöpferische Tätigkeit größtenteils im geeigneten Formulieren der Patentschrift liegt...
Um bei Deinem Beispiel zu bleiben, wäre eine hypothetische Patentanmeldung zum Beispiel ein "Verfahren zum Erzeugen gewisser Gefühlszustände beim Hörer durch abgestimmten Einsatz von Streichinstrumenten und Blasinstrumenten"...
Was Patente auf Software (Algorithmen oder deren Anwendung), Kochrezepte, mathematische Formeln, Spielregeln, Kompositionstechniken etc. von gültigen Patenten unterscheidet, ist die fehlende Technizität -- solche Erfindungen beschreiben lediglich mehr oder weniger abstrakte Gedankenvorgänge; keine technischen Verfahren. Und auf Gedanken sollte es keine Monopole geben.
(Höchstens auf deren konkrete Äußerung, durch Copyright... Wobei es auch hier wie wir wissen strenge Grenzen geben sollte :-) )

Nein, nicht wirklich. Sicherlich wird jeder Erfindung irgendwo eine Idee zugrunde liegen; aber die Idee muss weder bahnbrechend noch neu sein -- das ist nicht, was eine Erfindung ausmacht. Eine Idee ist an sich nichts besonderes. Sie kann natürlich beim Versuch aufkommen, ein bestimmtes Problem zu lösen (und dabei manchmal sogar einen Durchbruch bringen); aber Ideen können auch nebenbei anfallen, während man an etwas ganz Anderem arbeitet, oder gar durch den Park spazieren geht. Jeder hat tausende von Ideen im Verlaufe seines Lebens; und die allermeisten Ideen hatten auch schon tausende von anderen Leuten vorher... Eine Erfindung dagegen erfordert nicht nur Ideen, sondern vor allem Entwürfe, Prototypen, Experimente.
Niemand setzt sich hin, mit der Absicht eine einzigartige Idee zu haben. Leute setzen sich hin mit der Absicht, Lösungen für bestimmte Probleme auszuarbeiten.

Weil man auf Ideen nicht gezielt hinarbeiten kann. Eine Idee kommt, oder sie kommt nicht. Gezielt hinarbeiten kann man nur auf Lösungen konkreter Probleme.

Wie erklärst du Technizität?
Das habe ich im Prinzip gerade beschrieben... Viel mehr kann ich dazu nicht sagen. Der Technizitäts-Begriff ist nicht umsonst so umstritten in der Softwarepatent-Debatte.
Eine konkretere Antwort kann ich nur geben, wenn man bestimmte Felder betrachtet. Im Computer-Bereich zum Beispiel liegt die Unterscheidung zwischen Signalübertragung (Technik), und Datenverarbeitung (Mathematik).
Der BGH hat früher als eins der Patentierbarkeitskriterien angeführt, dass "eine neue Lehre über die Nutzung von Naturkräften" geliefert werden muss. (Oder so ähnlich... Weiß die exakte Formulierung nicht mehr.) Dieses Kriterium wird vom FFII unterstützt -- oder zumindest wurde es das, als ich die Debatten vor ein paar Jahren intensiver verfolgt hatte.

Ich hatte am Wochenende noch etwas überlegt und ich finde Idee im Moment doch besser als Erfindung. Erfindung hört sich immer sehr "hoch" an. Gerade bei Software-Patenten kommt finde ich Idee der Realität näher als "Erfindung".
