Hallo zusammen,
wir Ihr vielleicht wisst, hat die Bundesnetzagentur um Stellungnahmen bezüglich der Routerzwang-Thematik gebeten und diese mit einigen Fragen verknüpft [1]. Wir haben vorab schon ein erstes Schreiben an die BNetzA geschrieben, um unsere grundlegende Position mitzuteilen [2]. In Zusammenarbeit mit einigen Experten haben wir nun die ausführlichen Antworten fertig gestellt, würden vor dem Absenden (wahrscheinlich am 5.11.) aber gerne noch Eure Meinung einholen: Haben wir irgendwo falsche Fakten drin? Sind peinliche Rechtschreibfehler vorhanden? Haben wir ein elementares Argument vergessen?
Bitte schaut Euch den Entwurf im Anhang an. Er beinhaltet mit 11 Seiten zwar einiges an Text, aber es liegt in der Natur der Sache (und der Fragen der BNetzA), dass sich einige Argumente wiederholen.

Ich habe da 3 Sachen gefunden:
1) Mir kommt auf Seite 6 folgende Passage merkwürdig vor:

Hier wird der Endkunde zum reinen Konsumenten degradiert. Mag sein, dass das eine ganz andere Baustelle ist, und nicht so gut in die Netzneutralitäts-Debatte passt. Aber es passt zum Thema Routerzwang: Es geht nicht nur um Runterladen, sondern auch ums Hochladen! Es geht nicht nur um das Abrufen von Diensten, sondern auch um das Anbieten von Diensten.
2) Ein Befürworter von Routerzwang könnte argumentieren, man solle doch einfach einen zweiten Router hinter den mitgelieferten Router packen, und mit diesem so viel machen wie man will.
Das würde natürlich, solange wir noch mit IPv4 herummachen, "NAT hinter NAT" bedeuten, wo sich jedem Netzwerktechniker die Haare sträuben. Und das Anbieten von Diensten ist noch komplizierter. Aber es ist machbar und wird gemacht.
Gegen dieses Argument sollte man auch schon Gegenargumente sammeln, denn das werden die Routerzwang-Befürworter früher oder später bestimmt anbringen.
3) Es war mir nicht möglich, beim Überfliegen des Dokumentes festzustellen, ob es auf meinen Punkt 2) bereits eingeht oder nicht. Nun hätte ich alles gründlich durchlesen können, dazu fehlt mir aber die Zeit. Anderen wird es ähnlich gehen.
Daher: Das Dokument ist in meinen Augen zu sehr mit Technik- Begriffen überfrachtet und nicht besonders gut strukturiert. Es ist schwer, das Wesentliche auf den ersten Blick zu erkennen.
Mag sein, dass die BNetzA voller ehemaliger Telekom/Bundespost- Techniker ist, die diese Art von Texten lesen und lieben können. Sollte dem aber nicht so sein, würde ich anraten, den Text in Bezug auf Klarheit und Lesbarkeit zu überarbeiten. Die Grundideen sollten auf Anhieb klar werden, ohne dass man von Fachbegriffen erschlagen wird.

Absolut, da stimme ich Dir zu. Das ist jedoch natürlich nicht unsere Auffassung, sondern die der BNetzA. Wir greifen in dem Dokument diese Debatte sowieso nicht "beim Namen" auf, sondern eher die direkten und indirekten Auswirkungen einer unneutralen Verkehrsbehandlung: Wettbewerb, Diskiminierung, Kundengängelung... Und dabei wird Down- und Upstream beachtet, ohne dass wir uns hinter einem für viele unbekannten Begriff "verstecken".

Gerne! Fallen jemandem dafür noch ein paar Argumente ein? Im Entwurf stehen dafür IPv6-Probleme und die Stromkosten sowie die Sicherheitsbedenken, da das erste Gerät nach der TAE-Dose die gesamte Netzinfrastruktur aushebeln kann, sollte sie fehlerhaft sein.

Für den Überblick, den jeder 08/15-User versteht, gibt es das erste Statement [1], die Fragen der BNetzA sind augenscheinlich mit genügend technischem Hintergrundwissen gestellt worden, sodass es uns nicht gerade gut tun würde, diese nur oberflächlich zu beantworten. Wir müssen uns auch im klaren darüber sein, wer unsere Widersacher in dieser Debatte sind: Provider, Routerhersteller, profitierende Diensteanbieter. Diese werden diese Anfrage der BNetzA auch möglichst technisch beantworten, weil sie sich darin erhoffen, die BNetzA davon zu überzeugen, dass alles andere als rechtlich möglicher Routerzwang technische Probleme und Kosten verursacht. Dies müssen wir mit ebenso viel technischer Expertise kontern. Du magst richtig darin liegen, dass es einiges an technischem Wissen verlangt, den Text vollumfänglich zu verstehen, aber meine persönliche Meinung ist, dass wir technische Fragen auch mit technischen Details beantworten müssen.
Vielleicht gibt es aber noch mehrere Meinungen dazu. Ich lasse mich auch gerne überzeugen.
Wo ich aber einlenke, ist die Knappheit und Übersichtlichkeit des Textes. Die Argumente sollten noch präziser rüber kommen, das werde ich noch bis zur finalen Fassung verbessern.
Auf jeden Fall danke ich Dir für die Anmerkungen, die fließen wie gesagt in die Überarbeitung mit ein!
