nach dem Kauf eines Dell-Notebooks bin ich davon ausgegangen, dass ich die Lizenzkosten erstattet bekomme. Leider weigert sich Dell nun, mit der Begründung, dass sie nur das ganze System innerhalb von 2 Wochen zurück nehmen würden. Die 2 Wochen sind nun abgelaufen und ich komme mit argumentieren nicht weiter.
Für mich stellt sich die Frage, ob es sich lohnt rechtliche Schritte einzuleiten oder ob ich die Lizenz einfach bei ebay verkaufe. Ersteres wäre mir natürlich (um etwas gegen die MS-Steuer zu tun) am liebsten. Gibt's da von eurer Seite Erfahrungen oder Empfehlungen?

Der Schweizer Markus Dapp hatte von Dell Deutschland die Lizenzkosten zurückerstattet bekommen, der Bericht ist jedoch leider nicht mehr von unserer Refund-Seite [1] aus aufrufbar.

Da ich Deinen Fall nicht im Detail kenne, hier nur allgemein Anmerkungen:
Erstmal wäre die Frage der Frist zu klären. Wenn Du schon vorher mit denen in Kontakt standest, dann sind die 2 Wochen vielleicht nicht bindend. Eventuell kannst Du argumentieren, dass Du schon vorher einen Vorbehalt artikuliert hast. Weiterhin solltest Du prüfen, ob Du nicht das ganze System zurückgehen läßt. Am besten wäre dazu, dass sie ein Versprechen nachweislich nicht eingehalten haben - wie z.B. das Versprechen die Lizenzkosten zurückzuerstatten.
Irgendwo müsstest Du den Nutzungsbedingungen von Windows zugestimmt haben, sonst ist Dir ja keine Nutzung möglich. Dort stand vor Jahren mal, dass mensch die Lizenz zurückgegeben könne, wenn Ihr nicht zugestimmt wurde. Sofern dem noch so ist, könntest Du Dich darauf berufen. Ich denke, dass es auch eine Begründung sein könnte, das System als Ganzes zurückzugeben, wenn Dir die Nutzung einer Komponente (wie Windows) nicht möglich ist (weil Du nicht zugestimmt hattest.).
Am besten ist es, Dialoge schriftlich zu führen, damit Deine Seite mit Datum dokumentiert ist.
Sofern Du mit Dell unzufrieden bist, lohnt es vielleicht das weit öffentlich zu machen und das Dell auch mitzuteilen. Also z.B. der c't Abteilung "Vorsicht Kunde" schreiben.

Hallo Georg, ich habe vor ca. einem Jahr bei zwei Notebooks noch die Lizenzkosten zurückbekommen. Allerdings handelte es sich da um XP-Home-Lizenzen, in deren Text ein Rückgaberecht explizit enthalten ist. Mein Mitbewohner hat sich jetzt auch ein Dell XPS (mit Vista) geholt, und bekommt sein Geld auch nicht wieder, insofern würde mich auf jeden Fall interessieren was du da noch erreichst. Rechtlichen Rat kann ich dir leider nicht geben.
