weiter unten ist die Email eines Lehrers zitiert, der von einem Lehrmittelunternehmen aufgefordert wurde, eine Selbstbauanleitung für ein interaktives Whiteboard wg. mutmasslicher Patentverletzung aus dem Netz zu entfernen. Die Firma war so nett und hat erst eine Email geschrieben bevor sie eine Abmahnung verschickt. Man sollte also erstmal nett zu ihr sein.
Kann jemand dem Lehrer eine qualifizierte Antwort geben, ob er die Anleitung veröffentlichen darf? (Warum haben Schulbehörden keine Anwälte für solche Fragen?)

Argl, wie kann jemand ein Gebrauchsmusterschutz (laut Wikipedia sowas wie der kleine Bruder vom Patent[0]), wenn doch die Anleitung von Herrn Autenrieth schon vor der Erteilung des Monopols publiziert worden war? Mal ganz abgesehen davon, dass seine Anleitung wiederrum auf einer Idee von Jonny Chung Lee beruht, die laut seiner Website[1] schon in 2007 publiziert wurde.
Schade, dass diejenige Person, die den Schutz für gültig erklärt hat, noch nie was von Websuchmaschinen[2] gehört hatte. :(
Und nun noch was zur Sache:
IANAL aber ich glaube, ohne einen Anwalt wird es nicht möglich sein, ein wasserdichtes Schreiben zu verfassen. Die FSFE anzuschreiben ist auf jeden Fall eine gute Idee, denn die unterhalten eine Juristen-Netzwerk[3], dass zumindest in Freie Software-Fällen verwendet werden kann. Inwiefern der Whiteboard-Fall aufgrund seiner Nähe zum 'Lieblingsthema' Softwarepatente bearbeitet werden kann, kann ich nicht beantworten und muss von den angesprochenen geklärt werden. Ein Versuch sich dort zu melden, ist es aber auf jeden Fall Wert.

Nur ganz kurz, und natürlich alles unter IANAL Vorbehalt.
Kann also komplett falsch sein, nur Anwalt fragen hilft der endgültigen Klärung, z.B. mal bei http://jbb.de nach Dr. Till Jäger & Co fragen.
Davon aber abgesehen:
Grundsätzlich ist ein Patent ein Monopol auf kommerzielle Verwendung einer Idee, welches erteilt wird damit der Erfinder seine Idee nicht geheim hält, sondern veröffentlicht.
Die Veröffentlichung einer Idee auf Basis eines Patents einschränken zu wollen scheint also auf recht dünnem Eis zu stehen. Beim Urheberrecht ist das anders, aber darum geht es hier ja scheinbar nicht.
Darüberhinaus ist es tatsächlich denkbar, dass das Patent aufgrund einer vorherigen Publikation ("prior art") nicht erteilt werden darf/durfte.
Sofern es bereits erteilt ist, müsste man die Löschung beantragen, wenn es noch in der Prüfung wäre, könnte man das Patentamt mal auf die Existenz von prior art hinweisen damit es garnicht erst erteilt wird.
Hier würde ich mal ansetzen:
- Patent geht mit Veröffentlichungsverpflichtung einher, daher wäre u.U. ein Hinweis auf das Patent anzubringen, und kommerzielle Verwendung eingeschränkt, aber Selbstbauanleitungen vermutlich nicht betroffen.
- Patentstatus prüfen. Wenn noch in der Prüfung, sofort Patentamt auf Prior Art hinweisen. Ansonsten kann ein Löschungsverfahren teuer und langwierig werden und ist dann vermutlich nicht mehr im Interesse des Betroffenen.
Den Hinweis und die Belege für entsprechende Prior Art kann man dann aber eventuell bei der Bauanleitung dokumentieren, falls jemand das doch kommerziell verwenden will und es im Zweifel auf ein Gerichtsverfahren ankommen lassen will.
Empfehlen würde man sowas generell aber nicht, weil Gericht immer Risiko und Kosten bedeutet.
Und zudem: Immer mit einem Anwalt absprechen.
Für das Obige gibt es keinerlei Gewähr!
