Interwssant ist daß er sich selbst widerspricht: Im aktuellen LinuxMagazin gibt er auch ein Interview als Reaktion auf die Kritik. u.a.:
Unsinning ist auch, daß angeblich die Unzulässigkeit des Haftungsausschlusses der GPL zum Wegfall der Nutzungs- und Verwertungsrechte führe. Wer die Studie gelesen hat, weiß, daß je nach Distributionsformdas Schenkungsvertragsrecht mit seinen Haftungserleichterungen eingreifen kann (Download).... Ein Wegfall der Rechte folgt daraus nicht.
Im IDG Interview als Fazit:
... Second of all, and most importantly, the liability clause has to be replaced or adapted. This is definitely in the interest of users, open source developers and competition.

Der Verfasser der Studie hat nie behauptet, daß die welt der "proprietären" Software völlig frei von Rechtsproblemene sein. Im Gegenteil: Vieles lässt sich weiter- und fortspinnen.
Wenn er es auf eine fachliche Ebene bringen will, dann sollte er aber auch nicht irreführende Interviews für IDG geben. Das sieht ja ganz so aus, als ob er davon ausgeht, bei den Amis kann man es mit FUD ja nochmal versuchen, wogegen man in Deutschland schon zurückrudern mußte.

Die Akten liegen sicherlich vor. Die fsf war als Nebenklaeger beteiligt. Ueber einen RA aus Berlin. Ich weiss nicht, ob es OK ist, oeffentlich den Namen zu nennen, aber er duerfte Euch beileibe kein Unbekannter sein :-) Der Fall wurde in NRW (Bonn und Koeln) verhandelt, Revision ausgeschlossen.

Die angesprochene Fall ist uns bekannt. Die GPL spielte für die Entscheidung juristisch nach unserer Bewertung in der vorgelegenden Konstellation dann doch keine Rolle. Die Begründung des Gerichts dafür mag seltsam gewesen sein, aber daraus läßt sich nicht schlußfolgern, dass die GNU GPL in Deutschland unwirksam wäre.
Darum hat Christian wohl gefragt.
