Bei diesen Meldungen ist mir nicht ganz klar, wie stark sie dramatisiert wurden.
Es könnte eine generelle Abneigung gegen freie Lizenzen sein.
Es könnte aber auch einfach nur sein, dass sie ein Problem bei CC-Lizenzen mit Nichtkommerziell-Klausel (NC) haben, welche leider(!) in den allermeisten CC-lizensierten Werken angewendet wird.
Was davon nun wirklich der Fall ist, konnte ich den Berichten leider nicht eindeutig entnehmen.
(Das Angebot dieser unsäglichen NC-Klausel ist in meinen Augen ein großer Designfehler in den CC-Lizenzen. Denn "SA" bietet alle Vorteile von NC, ohne sich die Nachteile einzuhandeln. Aus Unwissenheit nehmen die meisten dennoch NC, weil das ja erstmal nett klingt, so als träfen sie damit die böse Industrie. *sigh* Aber naja, das hatten wir ja bereits.)

Dann muss man innerlich umdenken, wenn man freie Inhalte "verschenkt". Die meisten Leute denken, auch so, XY hat dies kopiert und verkauft es und wird reich dabei, das ist eine Sauerei. Ich hatte das übrigens in Fefes Blog gelesen und habe schon fast geahnt, dass das wieder so ein Beitrag ist, wo letztendlich das Gegenteil von seiner "Zusammenfassung" drinsteht, wenn man dem Link folgt. Wenn sich die Freie-Software-Community ebenfalls so komisch haben würde, wären wir nicht da, wo wir heute sind. Insbesondere hätten sich kaum Software-Distributionen bilden können, die sich in der heutigen (aber wohl auch schon in der damaligen) Zeit zu einem wahren Segen für die Software-Welt entwickelt haben.
Natürlich ist es ärgerlich, wenn jemand etwa eine OpenOffice-CD für 20 EUR statt 0,20 EUR vertreibt. Aber das hält sich doch nicht lange. Ich meine, es gibt auch Leute, die überteuertes Zuckerwasser verkaufen. Muss man dagegen ernsthaft vorgehen? Schadet das den Wasserwerken?
Und selbst wenn, dann doch bitte mit den _richtigen_ Werkzeugen, also Meldung beim Verbraucherschutz, Anzeige wegen Betruges (falls einer vorliegt) oder Anzeige wegen unlauterem Wettbewerb (falls überhaupt einer vorliegt). Das Urheberrecht ist kein geeignetes Werkzeug, um das auszufechten.
Ich meine, um eine Schraube in die Wand zu kriegen, kann man natürlich einen Hammer verwenden. Das geht irgendwie. Aber das Ergebnis ist nicht das, was man möchte.
Und genauso ist es meines Erachtens nach mit der NC-Klausel. Das hat einfach unerwünschte Seiteneffekte. In diesem Fall, dass die Leute sich damit die Chance verspielen, über das Radio bekannter zu werden.

Denn für solche Geschäfte muss man es verstehen, die Leute über den Tisch zu ziehen, das hat nichts mit der Qualität der Waren zu tun. (außer dass die Qualität nicht _zu_ schlecht sein darf. Obwohl ... ;-))
Es ist ein weiter Weg von "die meisten Leute" zu "unsereins", und es ist vielleicht tatsächlich nicht optimal für alle Profis.
Es ist halt immer die Schere zwischen Bekanntwerden/Aufmerksamkeit (Kundschaft vergrößern) und Sachen verkaufen (Einzelstückpreis vergrößern).
Nicht jedes einzelne Geschäft muss den maximalen Profit erzielen, sondern in der Summe muss es sich lohnen. CC-Musik ist wie eine Gefälligkeit oder ein besonders günstiges Angebot. Sowas kann sich langfristig 100fach auszahlen, oder auch nicht. Das muss man halt abwägen, das gilt für große Firmen, kleine Selbstständige und auch Privatpersonen gleichermaßen.
Wer sein Werk (seine Musik) unter eine freie Lizenz stellt, sollte sich über seine Ziele im Klaren sein. Will man damit bekannt werden oder Geld machen? Klar, am liebsten beides zugleich, aber das ist Humbug. Wer daran glaubt, sollte lieber Lotto spielen, da gibt's die gleichen Gewinnchancen, und es erfordert viel weniger Arbeit. ;-)
Die NC-Klausel vereint zwar scheinbar beide Ziele, Bekanntheit und Geld machen, aber ich denke, sie vereint eher die Nachteile als die Vorteile.

Hier geht es um Abofallen -- also Situationen, bei denen Leute *ungewollt* einen kostenpflichtigen Vertrag abschließen, indem sie einen scheinbar kostenlosen Download tätigen. Das ist etwas völlig anderes, als wenn Jemand bewusst für eine Kopie freier Werke bezahlt. Es hat mit dem Thema dieser Diskussion eigentlich Nix zu tun -- bei sowas handelt es sich, ganz unabhängig von der Lizenz, um eine illegale Praxis, die auf bewußter Täuschung basiert...

Auch hier: Inwiefern bezieht sich das auf mein Geschriebenes? Weder GPL noch die OpenSSL-Lizenz verbieten den gewinnbringenden Vertrieb durch z.B. gepresste CDs.

Ja, das schätze ich auch. Aber was ist so schlimm daran? Wiegesagt, es wird auch Zuckerwasser (oder sogar bloßes Wasser) überteuert verkauft. Sollten die Wasserwerke dagegen vorgehen?
Zur Begründung der Analogie: Wasser ist für uns so gut wie kostenlos. Wenn man sich bei jemandem eine Flasche Wasser abfüllt, würde man niemals den Satz erwarten: "Das bezahlst du mir aber!" Okay, man hat natürlich eine Wasserrechnung im Monat, aber das ist eher vergleichbar mit dem Internetanschluss, den man bezahlt, um OpenOffice herunterladen zu können.
In dieses Wasser schütten Leute Zucker hinein und verkaufen das deutlich über dem Wasser- und Zuckerwert, als Heilmittel oder ähnliches.
Sollten die Wasserwerke deshalb die kommerzielle Verwendung ihres Wassers untersagen? Bzw. nur durch einen extra Aufschlag von 10 EUR pro Liter? Gewisse Leute dürften selbst dann noch einen Profit heraus holen, aber der breite Getränkemarkt würde verschwinden. Das wäre ziemlich schade. Und vollkommen sinnlos.
Diese Annahme, "da macht jemand Geld mit _meinem_ Produkt", die sollte man sehr genau überdenken. Womit wird hier wirklich Geld gemacht?
Wenn es wirklich um das Produkt ginge, könnten die OpenOffice-Leute doch einfach selbst OpenOffice-CDs für 80 EUR (billiger als die 96 EUR der Konkurrenz) auf den Markt werfen. Das Geld können sie sicher sinnvoll verwenden. Warum machen sie es nicht? Weil es nicht funktioniert.
Egal ob überteuertes Zuckerwasser, überteuerte Freie Software oder überteuerte freie Grafiken: Will man daraus Profit schlagen, muss man einen sehr großen Haufen Idioten kennen. Und man muss wissen, wie man diese erreicht. Diese "Kundenliste" ist das eigentlich Wertvolle, was den 2-3stelligen Profit je Stück ermöglicht. Nicht das kostenlose bzw. extrem preiswert erhältliche Zeug, das sie denen verkaufen.

... Genau. Es sind aber nicht unbedingt Idioten, die so was kaufen. Eindrücklicher als bei CC ist es bei PD (Public Domain) Material. Viele Anbieter bieten z.B. PD Musik oder Bilder zu gesalzenen Preisen an, weil sie die einzigen sind, welche diese gleichzeitig archiviert haben und bewerben. Es steht aber dann dem Kunden frei, sie nachher z.B. auf Archiv.org zu deponieren. Umgekehrt bieten öffentliche Bibliotheken manchmal Scans von PD-Büchern an, gratis oder unter dem Selbstkostenpreis, verbieten aber dann die öffentliche Nutzung, was meiner Ansicht nach falsch ist.

"Kaufen" verstehe ich so, dass ein Anbieter einen Preis nennt und man sich freiwillig entscheiden kann ob man den Preis gerechtfertigt findet und kauft oder ob man das Produkt bei einem anderen Anbieter oder gar nicht beziehen möchte.
Es steht schlicht und einfach jedem frei, vor dem Kauf nach alternativen Angeboten zu schauen und zu vergleichen. Wer dennoch einen hohen Preis für etwas zahlt das den Wert gar nicht hat, verhält sich dann eben nicht besonders klug.

Das ist doch so gut wie synonym -- ohne Profitwunsch würde kaum jemand Handel treiben... (Im Deutschen ist "kommerziell" heutzutage praktisch ein Synonym für "profitorientiert". Im Englischen sind es prinzipiell unterschiedliche Begriffe -- aber in der Praxis kommt es trotzdem meistens auf's Selbe hinaus.)

Das stimmt zwar, aber die aller, aller meisten Leute wissen das nicht. Genau wie 90% der Leute sich für Gesetze und Richtungen entscheiden, die nur der wenigen reichsten Prozente der Bevölkerung nützen, weil sie potentiell auch zu diesen Reichsten gehören möchten. Ich arbeite gerade an einen Buch mit mehreren Autoren. Die Produktion ist sehr teuer und der Verkaufserlös dürfte die Kosten bei weitem nicht decken. Das macht nicht so viel, da der Zweck des Buches die Verbreitung von Wissen und nicht der Profit ist. Trotzdem ist es ein riesiger Krampf, die anderen Autoren und Photographen, die teils gut bezahlt werden, nur zu einem CC-BY-NC-SA zu überreden, eine weitere Lockerung ist aussichtslos.

Ich arbeite gerade an einen Buch mit mehreren Autoren. Die Produktion ist sehr teuer und der Verkaufserlös dürfte die Kosten bei weitem nicht decken. Das macht nicht so viel, da der Zweck des Buches die Verbreitung von Wissen und nicht der Profit ist. Trotzdem ist es ein riesiger Krampf, die anderen Autoren und Photographen, die teils gut bezahlt werden, nur zu einem CC-BY-NC-SA zu überreden, eine weitere Lockerung ist aussichtslos.
Sie werden gut bezahlt, und wollen gleichzeitig Exklusivrechte behalten? Das ist absurd. Such Dir vernünftige Mitstreiter...

So streng würde ich das nicht sehen. Ich würde eher argumentieren, dass SA bereits dafür sorgt, dass es keine dauerhafte finanzielle "Ausbeute" gibt, da alle darauf aufbauenden Werke wieder unter freier Lizenz stehen, und damit insbesondere von jedermann kopiert werden dürfen. Will sagen, man hätte den Leute von vornherein einfach CC-BY-SA anbieten sollen, und das als "strenger als NC" kommunizieren können. Aber im Nachhinein sagt sich sowas natürlich leicht.
Aber genau darin sehe ich auch den Designfehler in den CC-Lizenzen. Eine dermaßen kontraproduktive Variante wie "NC" hätte sie niemals mit aufnehmen sollen. Dann hätte dieser Unsinn im Siegeszug der Idee der freien Lizenzen niemals Fuß fassen können. Die Leute hätten sich von vornherein direkt an die Idee des Copyleft (CC-BY-SA) gewöhnt, und müssten nicht noch extra zusätzlich überzeugt werden.
Genauso ist das ja bei den Freie-Software-Lizenzen. Da hat sich von vornherein der Konsens gebildet, dass eine NC-Klausel oder ähnliches nicht mehr als freie Lizenz gilt. Gut, eine CC-Lizenz mit NC-Klausel ist ebenfalls keine freie Lizenz, aber in der öffentlichen Wahrnehmung eben (leider) schon.
Klar könnte man jetzt argumentieren, dass es dank NC-Option mehr CC-lizensierte Werke gibt als ohne. Aber dafür haben auch viele Leute NC gewählt, die sonst einfach BY-SA gewählt hätten. Das heißt, wir hätten weniger CC-Lizensierte Werke, aber dafür mehr _freie_ Werke. Letzteres wäre in meinen Augen deutlich erstrebenswerter gewesen. NC ist ein fauler Kompromiss - ein Designfehler.

Ja, aber diese Denke ist schlicht und einfach Blödsinn. Niemand wird davon reich, fremde Werke zu verkaufen, die frei verfügbar sind. Um reich zu werden, muss man einen Mehrwert bieten.
Manchmal reicht es auch, den Mehrwert bzw. Gesamtwert einfach zu suggerieren. Wer an Leute herankommt, bei denen das funktioniert (also an sog. "Idioten" herankommt), der kann kostenloses Zeug sogar _ohne_ jedlichen Mehrwert gewinnbringend verkaufen. Und genau das passiert auch im Falle der OpenOffice-CDs.
