Danke, also ich hätte das jetzt einfach so hingenommen und einfach nur der Prüfpauschale widersprochen. Weil der Post ist ja EU weit bezogen, dachte nicht, dass man alles für Deutschland übernehmen kann.

Aber wäre nett, wenn sich jemand dazu äußern könnte. Werde noch bis Montag mit dem Antwortschreiben warten, es sei denn jemand sagt er kümmert sich um eine Aussage dazu, dann warte ich. Defekt ist es sowieso...

Auch das kann die Analyse widerlegen:

the defect arises now, the seller can claim that the defect was caused by some action that was triggered by non-normal use of the device.
But in order to avoid needing to repair or replace your device, the
seller has to prove that your action caused⁵ the defect. It is generally recognised by courts that unless there is a sign of abuse of the device, the defect is there because the device was faulty from the beginning. That is just common sense, after all.
Sprich, der Händler muss im Gegenzug nachweisen können, dass DU den Fehler verursacht hast, denn er wirft Dir vor, mithilfe einer Modifikation der Software einen Hardwaredefekt verursacht zu haben. Wie ich in der vorigen Mail schon zitiert habe, kann dies aber nur in ganz seltenen Fällen der Fall sein (Lautsprecher killen). Er soll Dir also klar darlegen, wie er sich vorstellen kann, dass neue Software den USB-Port grillt.
Ich muss aber ehrlich sagen, dass ich mit meiner juristischen Laienkenntnis auch von der Nachweispflicht aufseiten des Käufers nach 6 Monaten gehört habe, was ja eigentlich der Analyse widerspricht.
@Michael, könntest Du da bitte ein bisschen Licht ins Dunkle bringen?
Werde jetzt noch nen Schreiben aufsetzen, dass ich die Prüfpauschale
rechtlich
nicht in Ordnung ist und das Handy wohl defekt zurück erhalten...
Ich würde jetzt keine voreiligen Mails schreiben, sondern vielleicht tatsächlich warten, bis sich ein juristisch fähigerer Mensch als ich sich zusätzlich zu der Sache geäußert hat. Dann hast Du einfach später mehr Argumente.
