hiermit möchte ich die am 19.11.2010 gemeinsam mit einem Dell Vostro 3500 erworbene Windows-7-Lizenz gemäß des End User License Agreement (EULA) von Microsoft Windows zurückgeben, da ich diese nicht mit reinem gewissen aktzeptieren kann.
Ich habe der EULA nicht zugestimmt, da sie zahlreiche für mich inakzeptable Punkte enthält, beispielsweise:
- Die Aktivierung der Software sendet Hardware-Informationen an Microsoft (Punkt 4 des EULA).
- „Internetbasierte Dienste“ wie das „Windows-Updatefeature“ können von Microsoft jederzeit gesperrt werden (Punkt 7 des EULA). Dadurch existiert de facto kein Recht auf Security-Updates.
Ich entschied mich stattdessen für das Konkurrenz-Produkt Ubuntu, da dieses eine bessere Qualität aufweist und ein verbraucherfreundlicheres EULA hat.
Ich bitte Sie deshalb, mir die Kosten für die Windows-Lizenz zurückzuerstatten und die erworbene Windows-Lizenz einzeln zurückzunehmen.
Weiterhin bitte ich sie auch die Software Power DVD 8.3 und Roxio 10.3 ebenfalls zurückzunehmen, da ich diese ohne Windows dann nicht nutzen kann.

EULA würde ich nicht schreiben sondern Lizenzbedingungen. Das mit der Qualität würde ich auch nicht schreiben, denn davon hängt deine Entscheidung ja nicht ab (ist so ein "Open-Source-Argument"). Das Recht wirst Du auch bei anderen Betriebssystemen lange suchen müssen.

Wieso? Es geht MSFT eigentlich nichts an, welche Distro Du verwendest. Außerdem könntest Du ja Linux from scratch installieren...

Das ist vielleicht nicht perfekt formuliert, aber dennoch eine heftige Einschränkung. Keine Freie-Software-Distribution behält sich das Möglichkeit vor, einzelne Systeme von Security-Updates auszuschließen.
Diese Option existiert schon rein technisch gar nicht, denn dazu müssten individuelle Systeme überhaupt erst einmal identifizierbar sein. Zudem müsste das Projekt dann alle Mirrors kontrollieren, einschließlich der inoffiziellen Mirrors irgendwelcher Unis.

So, wollte mal nachfragen, was ich nun tun soll: Ich habe 2 Notebooks bei Dell bestellt und die kamen zu verschiedenen Zeiten an. Am 1.12.2010 kam das silberne Dell Vostro 3500 an und am selben Tag habe ich folgendes geschrieben:

Nun kam das zweite Dell Vostro 3500 am 06.12.2010 an und ich hatte ich hatte Probleme mit dem USB Ports und eine total unfähige Supportlerin... Hab dann an ihre Vorgesetzte geschrieben, welche mir über die Email "Consumer_Customer_Care_Escalations@Dell.com" geantwortet hat^^ Nunja, es sieht so aus, als würde das Problem nun endlich beseitigt werden. Bis es beseitigt wurde, möchte ich aber lieber für das 2. Notebook keine Windows Steuer Erstattung anfordern und auch das Nachhaken, was nun mit der Windows Steuer Erstattung fürs 1. Notebook geworden ist, werde ich machen, wenn ich nen heiles 2. Notebook habe.
Aber wie soll ich weiter vorgehen, wenn anscheinend nicht auf mein Anschreiben geantwortet wird? Und wie lange sollte ich auf eine Antwort warten? (Mitlerweile 11 Tage her)

Solch ein Problem ist im Nachhinein immer schwierig zu handhaben.
Besser ist es, bei solchen Schreiben grundsätzlich im Voraus eine Frist zu setzen. Man kann es ja nett formulieren und die Frist einigermaßen großzügig ansetzen, etwa so:
"Für eine Antwort bis zum {Heute + 14 Tage} wäre ich Ihnen dankbar."
Das hat auch den Vorteil, dass Du Dich in späteren Schreiben auf diese Frist beziehen kannst, und zudem einen Stichtag hast, an dem Du nachhakst. Den Stichtag am besten im Kalender eintragen.
Ob das aber wirklich zu schnelleren oder gar besseren Antworten führt, weiß ich nicht. Es ist halt ne psychologische Sache.
Wenn Du nachhakst, solltest Du natürlich wiederum eine weitere Frist setzen, und so weiter, sodass die Leute merken, dass Du sie in regelmäßigen Abständen immer weiter nerven wirst, bis sie sich endlich um eine Antwort bemühen. Auch für Dich selbst ist das wiegesagt nützlich, weil Du dann auch eine Frist für Dich selbst hast.

Was hat das mit deinem Gewissen zu tun? Das ist eine Produktrückgabe und kein Antrag auf Kriegsdienstverweigerung. ;-)

Oder diesen Satz ganz streichen, denn ich vermute, dass der Hersteller weder für Power DVD noch für Roxio etwas bezahlen musste. Und was für Geld will man dann zurückverlangen? Wer weiß, vielleicht _erhält_ der Hersteller sogar Geld dafür, dass er diese Programme durch Vorinstallation bekannter macht.

Da kann durchaus was dran sein: Ein Hersteller (weiß nicht mehr welcher) bietet tatsächlich an, gegen *Aufpreis* ein System mit weniger vorinstalliertem Müll auszuliefern...
