Ich hab da mal einige Fragen zum FSFe Verein
1) Ist der FSFe Verein auch gleichzeitig der Deutsche Landesverein, wie in §6(1) der Satzung?
2) Sind Mitglieder der Landesvereine auch stimmberechtigte Mitglieder des FSFe Vereines? Hat damit jedes Mitglied doppeltes Stimmrecht, auf nationaler und auf Europäischer Eben? Oder wie habe ich mir die Einbindung der Landesvereine vorzustellen.
3) Ein Punkt der mich etwas stutzen liess :-) In §1(1) steht jeder kann Mitglied werden aber in §3(3) steht, dass ein neues Mitglied durch 3/4 Mehrheit der Mitgliederversammlung (?einmal im Jahr?) bestätigt werden muss. Wie hat man sich das vorzustellen, am Anfang der Jahresversammlung wird über 10^n Mitgliedsanträge abgestimmt. Oder soll dies dazu dienen die Anzahl der Mitglieder überschaubar zu halten? Auch wenn in $3(3) Satz 3 steht dass der Vorstand einem Mitgliedsantrag vorübergehend zustimmen kann bringt mich das etwas ins grübeln. Vorweg: Die rechtliche Organisation der FSFE in Europa folgt unseren Ideen, wie es eigentlich organisiert werden sollte. Es ist praktisch ein "juristischer Hack", welcher nie perfekt sein kann. Aber irgendwie müssen wir das beste daraus machen.

Die FSFE arbeitet als eine einzige Organisation. Insofern ist es wichtiger, was im Kernteam passiert und diskutiert wird.

Du meinst §3(1). Der gibt an, wer die Grundvorraussetzungen hat aufgenommen zu werden.

Wir halten die Mitglieder der juristischen Verein zu gering wie möglich. Dies ist das Kernteam. Die FSFE selbst ist also grösser als die formalen Mitglieder. Beispielsweise gibt es viele wichtige Freiwillige die dazu zählen. Hierbei ist es wichtig zu beachten, dass die Vereine eben nur eine Annäherung zur Unterstützung der Arbeitsweise der FSFE ist.

Bin auch kein Jurist. Hier ist es eine praktische Erwägung. Eigentlich wird das vorher im Kernteam diskutiert, wer zum Kernteam kommen möchte. Der Vorstand wird sich hüten der Mehrheit zu widersprechen. Nun wollen wir aber nicht warten, bis zur nächsten Mitgliederversammlung. Formal kann nur die aufnehmen, weil sonst der Vorstand einfach sich genügend Personen hereinnehmen könnte, welche ihn einfach wählen.
Ausserden stolpere ich gedanklich dabei wieder über die Aufteilung Nationaler/Europäischer FSF-Verein. Muss über eine Mitgliedschaft doppelt abgestimmt werden?
Formal ja. Inhaltlich nein, da es nur _eine_ FSF Europa gibt.

Ja das wars was ich wissen wollte. Aber warum lasst Ihr Euch die Chance entgehen auf breiter Basis Mitglieder ein zu binden. Wenn man einmal in Betracht zieht wieviele LinuxianerInnen sich auf irgendwelchen Seiten als Linux User Nr.:xx.xxx registrieren lassen kann man eine recht hohe Anzahl freiwilliger Mitglieder erwarten. Meines Erachtens wären eine grosse Anzahl der Linux Anwender bereit sich an einer Vereinsstruktur zu beteiligen, selbst gegen die Entrichtung eines Mitgliedsbeitrages von 120EUR. Selbst bei einer nur eingeschränkten aktiven Teilnahme des Mitgliedes an den Aktivitäten der FSFe-de würde in finanzieller Hinsicht garantiert ein besseres Ergebnis als mit den Spenden auf freiwilliger Basis erreichbar sein. Aus Sicht der Werbewirksamkeit für die FSFe-de wäre solch ein Konstrukt doch auch nicht zu verachten. Zum einen hätte man schon einmal einen festen Stamm von Interessierten die leichter, oder besser erfolgversprechender, mit Informationen über die Aktivitäten und Ziele der FSFe-de erreichbar wären. Und darüber hinaus hätte dies den Vorteil von vorne herein die Informationen der FSFe-de breiter zu streuen, mit der Erwartung das der eine oder andere diese Informationen aktiv weiterträgt. Aus meiner Erfahrung heraus sind sehr viele Linux Anwender bereit die "Idee" auch finanziell zu unterstützen, allerdings auf die Frage warum sie das nicht tun kommen immer wieder Antworten wie, "Keine Adresse bekannt", "Was machen die mit meinem Geld", "Die grossen Firmen bezahlen doch schon". Ich glaube die FSFe-de hat hier einen grossen Vorteil, es setzt sich für die "Idee" ein die dahinter steht (kommt dem messianischen Eifer vieler Linuxianer entgegen), die Aktionen um den Einsatz von Linux im Bundestag haben vielen den Bedarf für eine Lobby Arbeit auf dieser Ebene bewusst gemacht. Die Liste mit den Spenden an die FSFe ist dagegen ein recht entäuschendes Zeugnis für die Breitenwerbung. Tschüss, Thomas

Das ist eine Bezeichnungsfrage. Wir versuchen ehrlich zu sein und gleichzeitig die Strukturen traditionell offen für Mitarbeit zu lassen.

Die Freie Software Gemeinde war immer sehr offen für Leute, welche sich einbringen möchten. Dafür braucht es eigentlich keine formale offizielle Organisation. Deshalb wird die auf ein Minimum beschränkt. Wir empfehlen dann aber zusätzlich offene Vereine (wie APRIL)zu gründen, von denen es ja mehrere geben kann fürs mitarbeiten.
Wenn man einmal in Betracht zieht wieviele LinuxianerInnen sich auf irgendwelchen Seiten als Linux User Nr.:xx.xxx registrieren lassen kann man eine recht hohe Anzahl freiwilliger Mitglieder erwarten.
Schon, aber wenn diese Mehrheit dann abstimmt, besteht die Gefahr, dass es auf einmal nicht mehr GNU/Linux oder Freie Software heisst. Solche Debatten sind beim Kernteam kontraproduktiv.
Selbst bei einer nur eingeschränkten aktiven Teilnahme des Mitgliedes an den Aktivitäten der FSFe-de würde in finanzieller Hinsicht garantiert ein besseres Ergebnis als mit den Spenden auf freiwilliger Basis erreichbar sein.
Wir müssen tatsächlich unsere Öffentlichkeitsarbeit weiter verstärken. Andererseits wissen die Leute, welche uns spenden auch zu schätzen, dass wir viel Arbeit einfach erledigen oder jedesmal an die Öffentlichkeitswirkung einer Aktion zu denken.

Viele Linux-Anwender wenden auch proprietäre Software an. Die Hauptarbeit der FSF(E) richtet sich nicht auf den einen Betriebsystemkern sonderen auf das GNU-Projekt und der Freiheit von Software insgesamt. Beispielsweise gibt es auch Freie BSD-Systeme und den Hurd als Betriebssystemgrundlage.
Ich glaube die FSFe-de hat hier einen grossen Vorteil, es setzt sich für die "Idee" ein die dahinter steht (kommt dem messianischen Eifer vieler Linuxianer entgegen), die Aktionen um den Einsatz von Linux im Bundestag haben vielen den Bedarf für eine Lobby Arbeit auf dieser Ebene bewusst gemacht.

Aber wenn ich einmal Dein Beispiel der französischen APRIL aufgreife, die sind auch Mitglied (associée) in der FSF. Also ein möglicherweise übertragbares Konstrukt für einen FSFE-de Verein. Ich persönlich finde es weitaus problematischer eine Breitenwirkung mit vielen nebeneinander unabhängigen Vereinen zu etablieren als mit einer unter einem zentralen Dachverband, der möglichst nahe an der FSFe angegliedert ist. Abgesehen von der Gefahr der Zersplitterung, das Arbeiten doppelt gemacht werden, der schwierigeren Kommunikation untereinander... Wenn ich mir den FFII ansehe, dann werden dort auch nicht nur Linux unterstützt, sondern auch die anderen GNU Projekte. Also wenn jemand bereit ist für solch einen Verein senen Mitgliedsbeitrag zu geben, warum sollte er Vorbehalte dagegen haben es gegenüber einem FSFe-de Verein auch zu machen. Das Problem der Einflussname auf die FSF, so wie Du es geschildert hast, halte ich für nicht ganz unproblematisch. Ein Sprachrohr wie die FSF welches sich der aktiven Diskussion, auch auf breiterer Basis, entzieht wird über kurz oder lang erhebliche Probleme mit der Akzeptanz bekommen und sich u.U als obsolet erweisen. Auch wenn es hier nicht ganz passend ist sieht es für mich ein wenig wie die einmal diskutierte Gefahr der "Balkanisierung" (was für ein Scheiss Begriff) aus, also viele Vereine (Köche)... Das eine breitere Basis sehr viel mehr "Stress" für die FSF und gerade für die momentan Aktiven bedeutet sehe ich auch so, allerdings frage ich mich ob es nicht vielleicht überlegenswert ist dies in Kauf zu nehmen wenn die möglichen Vorteile überwiegen könnten. Georges Brave GNU World ist doch auch ein Beispiel für eine von Seiten der FSF unterstützten Informationsbasis. Damit ist sichergestellt, daß die FSF Europe auch bei Unterwanderung einer assoziierten Organisation handlungsfähig bleibt.
Wegen der besonderen Verantwortung der FSF war es notwendig, für solche (hoffentlich nie eintretenden) Fälle Vorkehrungen zu treffen.

Ein offener deutscher Verein für Freie Software ist durchaus etwas, was auch meiner Meinung gut wäre. Wenn Du Dich gerne in einem solchen Verein engagieren möchtest und vielleicht sogar bereit bist, diesen zu strukturieren/organisieren, würden wir das sehr begrüßen und Dich dabei gerne unterstützen.
Ähnliches ist bereits in Österreich (FFS), Portugal (ANSOL), UK (AFFS) und bald auch in den "nordischen" (Schweden, Dänemark, Norwegen, Finland) Ländern geschehen.

Richtig. Eine Assoziierung mit dem FFII bietet sich ebenfalls an und ist im Moment außerordentlich wahrscheinlich. Dazu in den nächsten Wochen mehr.
Wenn Du also lieber dem FFII beitreten möchtest als eine parallele Aktion mit anderem Fokus (deutscher Verein für Freie Software) zu starten, dann ist das sicherlich auch keine schlechte Idee.

Völlig richtig. Hier hat die FSF NA (Nord Amerika) auch unserer Meinung nach nicht genug Wert auf den Dialog gelegt, was wir mit der FSF Europe ganz bewußt besser machen wollten.
Daher haben wir umfangreiche Möglichkeiten geschaffen, sich in die Arbeit der FSF Europe einzubringen und mit der FSF Europe in Kontakt und Meinungs-/Wissensaustausch zu treten. Diese Liste ist eine davon.
Daneben befindet sich die FSF Europe selbstverständlich in permanentem Kontakt mit den aktiven Protagonisten der Szene - seien es Individuen, der LinuxTag oder der LIVE.
Du hast Recht, daß die Webseite noch nicht genug Informationen vermittelt, noch nicht übersichtlich genug ist und auch sonst Schwächen hat.
Auch wir sind damit nicht völlig zufrieden, aber unser Schwerpunkt im letzten Jahr lag klar auf der Schaffung der Strukturen, des fachlichen Unterbaus und der Sacharbeit.
Bei begrenzten Resourcen wurden daher Abstriche bei der Webpage notwendig, die Du völlig zu Recht beklagst. Hilfe zur Verbesserung oder bei der Schaffung von Resourcen ist uns sehr willkommen.

Dies muß meines Erachtens nach etwas differenzierter betrachtet werden.
Die eine Organisation, die alle anderen Organisationen überflüssig macht und ihre Aufgaben übernimmt kann (und sollte) es meines Erachtens nach nicht geben.
Eine gewisse Vielfalt der Szene ist wichtig, belebend und auch in der Öffentlichkeitswirkung von Vorteil, da es gut und wichtig - sogar notwendig - sein kann, mit mehreren Stimmen von verschiedenen Richtungen zu argumentieren.
Allerdings sollten diese Initativen sich koordinieren und auch international stärker miteinander kooperieren.
Dies zu stärken und voranzubringen ist eine der Aufgaben, die die FSF Europe auch nach unserem Verständnis übernehmen kann und sollte und war einer der Gründe warum wir den assoziierten Status eingeführt haben.

Die FSF hält unter Anderem die Rechte am Großteil des GNU-Systems und ist der Herausgeber und stärkste (auch gerade juristische) Verteidiger der GNU General Public License und GNU Lesser General Public License, denen über 50% der Freien Software unterstehen.
Fehler in der Wartung der Lizenzen oder eine Lähmung der FSF zu einem prozesskritischen (durchaus auch juristisch zu verstehen) Zeitpunkt könnten sehr wohl im Interesse mancher proprietärer Unternehmen liegen und ein schwerwiegendes Problem für die Freie Software weltweit darstellen.
Du hast völlig richtig zu bedenken gegeben, daß es vermutlich das Einwerben von Spenden vereinfachen könnte; doch ich denke nicht, daß es in diesem Hinblick von unserer Seite verantwortliches Handeln wäre, sich Schwächen zu geben, die vermeidbar bzw. nicht absolut notwendig sind.

Richtig. Und ich bemühe mich trotz meiner Tätigkeit für die FSF Europe, sie weiterzuführen.
Aber trotz aller Freude, die ich darüber empfinde, wenn die Brave GNU World als wichtiger Teil der Aktivitäten betrachtet wird, muß ich doch sagen, daß die Folgen eines Untergangs der Brave GNU World nicht annähernd so kritisch wären wie die Folgen einer Unterwanderung der FSF.
Zu der Frage der Spenden sei noch gesagt, daß gelegentliche, spontane Spenden natürlich sehr viel unzuverlässiger sind als regelmäßige Mitgliedsbeiträge.
Wir haben in der Vergangenheit auch schon öffentlich (auf discussion) darüber nachgedacht, daß es sinnvoll wäre, wenn die privaten und kommerziellen Unterstützer der FSF Europe Daueraufträge in für die einzelne Person vertretbare Beträge einrichten würden.
Dies würden wir auch sehr gerne durch besondere Anerkennung würdigen, ein Mitgliedsstatus wurde von uns jedoch ausgeschlossen, da es nicht möglich sein sollte, sich die Mitgliedschaft in der FSF Europe zu erkaufen.
Der Hinweis auf mögliche monatliche Spenden ist übrigens ein Ergebnis dieser Diskussion.
Du hast völlig Recht, daß wir auch hier noch nicht genug Aktivitäten entfaltet haben, aber es ist Tatsache, daß Leute eher bereit sind, Organisationen zu unterstützen, die bereits Arbeit geleistet haben, als solche, die planen Arbeit zu leisten. Daher lag unser Schwerpunkt bisher darauf, ein solides Fundament zu schaffen, auch wenn das ohne ausreichende Mittel nicht immer einfach war.
Wenn Du uns jetzt dabei unterstützen möchtest, vielleicht ein Programm zu initiieren, um Leute dazu zu motivieren, die FSF Europe auch finanziell zu unterstützen, dann wäre das sehr hilfreich.
Ich hoffe, diese Mail hat zu größerer Klarheit geführt und hat ein paar Perspektiven aufgezeigt.

Das soll aber erst mal genug sur Satzung sein, sonst muss ich noch ein paar Semester Jura nachschieben. (und das liegt mir nun gar nicht) :-) Ich sehe da einen Vor- und einen Nachteil eurer Vorstellung. Der grosse Vorteil eines eigenständigen Vereines ist zum einen, es gibt bereits einige (Vereine/Gruppen) die sich der Förderung des Gedankens von Freier Software verschrieben haben. Und damit komme ich zum möglichen Nachteil in der Zukunft für den FSFe-de. Ohne eine von der Politik und den Verbänden akzeptierte Rechtfertigung, und das wird dort leider in der Regel mit einer masse Mitglieder verbunden, wird es die FSFe nicht einfach haben sich Gehör zu verschaffen. Schau Dir nur einmal die Kampagne von Werk21 an, dort ist viel von Demokratie die Rede, aber von den grundsätzlichen Prinzipien des FSF recht wenig. Mich würde ja mal die Reaktion von Richard darauf interessieren :-)) Der Schritt bis zur ersten Instrumentalisierung zu mehr oder weniger rein politischen Zwecken ist es meines Erachtens nur noch ein kleiner Weg.
Ich würde persönlich immer noch eine Erweiterung des FSFe-de bevorzugen, vor allem da ich momentan noch keinen anderen Verband/Verein sehe der mit dieser "Stimme" sprechen kann. Aber das mag sich ja in der nächsten Zeit ändern, hoffe ich doch.

Es gibt halt keinen "Deutschen FSFE", sondern nur eine Organisation, die als Dachverein und Landesverein organisiert ist. In Österreich gibt es noch keinen Landesverein.

Ja ich erinnere mich auch gern an meine Zeit in der Hochschulpolitik. :) Da unterscheidet sich die FSFE glücklicherweise. Wir sind sehr koordiniert. Koordination ist eine Hauptaufgabe. Dann ist die FSFE nicht im politischen Tages oder Jahresgeschäft.
Ohne eine von der Politik und den Verbänden akzeptierte Rechtfertigung, und das wird dort leider in der Regel mit einer masse Mitglieder verbunden, wird es die FSFe nicht einfach haben sich Gehör zu verschaffen.

Es gab Kommunikation mit den Werk21 Leuten. Wer genau hinsah, hat schon etwas Wissen aus der FSFE-Ecke gesehen. Das wird auch noch mehr. :)
Richard reagiert bei so etwas meist damit: + Können wir Ihnen es erklären, warum es besser über Freiheit zu reden? + Eine Entscheidung zwischen windows und "linux" ist nur ein kleines Signal, egal wie es ausgeht.

Wir sind für Erweiterung weit offen. Nur ins Kernteam nehmen wir erst nach einiger Zeit auf. Wenn wir die Person persönlich kennen und sie langfristig tätig ist. Du kannst ohne formal im Kernteam wichtige Arbeit machen und involviert sein.

Es gingen viele Überlegungen in die bisherige Struktur. Sie ist tatsächlich etwas aussergewöhnlich zu anderen politisch paticipativen Gruppen, welche potentiell viele Leute anziehen. Andererseits stellt die Langfristigkeit des Ziel auf andere Heranforderungen.

Wenn ich Thomas richtig verstanden habe, meinte er Linux-Anweder weder ausschließlich noch in dem Sinne, dass die FSF(E) Linux mehr unterstützen sollte als andere freie Projekte, sondern einfach als die (derzeit) größte Gruppe von Anwendern freier Software, unter denen vermutlich auch viele gerne etwas beitragen möchten, vor allem auch finanziell -- diejenigen, die durch Mitarbeit helfen wollen, tun das vermutlich in den meisten Fällen schon, aber bei denen, die das nicht wollen oder können (auch evtl. zeitlich) und "nur" finanziell beitragen möchten, spielt oft auch die Bequemlichkeit eine große Rolle. (Das ist nicht negativ gemeint.)
Natürlich kann man sich die Spendenadresse auf der Webseite suchen und dann immer mal wieder einfach was überweisen, aber das ist doch eher ungewöhnlich. Im Gegensatz dazu meldet man sich bei einem Verein einmal an, bekommt dann vielleicht noch einen schönen Mitgliedsausweis (der in der Praxis nicht viel Bedeutung hat, was die meisten potenziellen Mitglieder auch kaum anders erwarten würden), und bezahlt dann regelmäßig (per Dauerauftrag oder Einzug) seine Beiträge.
Und wenn man "auch proprietäre Software an[wendet]", darf das natürlich auch kein Hinderungsgrund sein. Es kann ja nicht das Ziel sein, Unterstützung nur von denen anzunehmen, die sich von schon voll und ganz der Sache verschrieben haben (diese dürften inzwischen wohl eh alle hier o.ä. zu finden sein ;-) -- gerade so, als ob ein Tierschutzverein nur nachgewiesene Vegetarier als Mitglieder annimmt. Sie können ja durch die Mitgliedschaft gerade dazu beitragen (wenn auch indirekt), freien Ersatz zu schaffen für die proprietäre Software, die sie (noch) benutzen.
Um der Gefahr der Übernahme vorzubeugen, müsste der Verein doch eigentlich nur formell separat von der FSFE sein (noch ein Verein mehr ...), also eine Art Förderverein, der dann z.B. entscheiden kann, mit seinen Beiträgen die FSFE zu unterstützen. Das Schlimmste, was bei einer Übernahme passieren kann, wäre dann, dass die Mehrheit entscheidet, das Geld anders zu verwenden. Dann können die gutmeidenden Mitglieder einfach austreten (und einen neuen Verein gründen), und der FSFE entsteht kein Schaden.
Ich glaube die FSFe-de hat hier einen grossen Vorteil, es setzt sich für die "Idee" ein die dahinter steht (kommt dem messianischen Eifer vieler Linuxianer entgegen), die Aktionen um den Einsatz von Linux im Bundestag haben vielen den Bedarf für eine Lobby Arbeit auf dieser Ebene bewusst gemacht.
Die Liste mit den Spenden an die FSFe ist dagegen ein recht entäuschendes Zeugnis für die Breitenwerbung.
Zugegeben da müssen wir besser werden. Vorschläge und Hilfe sind willkommen.
Ich hatte Thomas' Beitrag durchaus als Vorschlag verstanden. :-) Es ist nicht gerade eine neue Erkenntnis, aber um viele Spenden zu bekommen, braucht man entweder einige Groß- oder viele Kleinspender (oder beides :-). Mit ersterem kenne ich mich nicht aus, aber das klappt ja anscheinend (noch) nicht so gut, und letzteres läuft hierzulande typischerweise eben über Vereinsmitgliedschaften ...

Zugegeben wollte ich eben das weitere Problem demonstrieren, viele Anwender Freier Software wissen nicht, dass es hier einen Kernwert gibt. Die FSF* schafft beispielsweise die Grundlagen, um solche Kernwerte zu vermitteln.

Es war dem Kernteam durchaus bekannt, das dies üblich ist. Wir haben aber vorerst gegen diese Möglichkeit Bilanz gezogen. Aus den bereits angesprochenen Gründen.

Ja, so ein Verein wäre hilfreich. An den denken wir ja auch mit der Möglichkeit der Assozierung von Vereinen. Aber nicht alle müssen gleich allgemein aufgestellt werden.
Ich bin zum Beispiel auch Mitglied in der GRASS Anwender Vereinigung e.V. (grass-verein.de). Ein kleiner junger Verein der Freie Software im Bereich Geographische Informationssysteme im Allgemeinen und GRASS im Besonderen fördern möchte. Das freut auch die FSFE.
