Sehr geehrte Damen und Herren,
hiermit möchte ich die am 23.12.2010 gemeinsam mit einem Dell Vostro 3500 erhaltene Windows-7-Lizenz gemäß des End User License Agreement von Microsoft Windows zurückgeben, da ich diese nicht mit reinem Gewissen aktzeptieren kann.
Ich habe den Lizenzbedingungen nicht zugestimmt, da sie zahlreiche für mich inakzeptable Punkte enthält, beispielsweise:
- Die Aktivierung der Software sendet Hardware-Informationen an Microsoft (Punkt 4 der Lizenzbedingungen).
- „Internetbasierte Dienste“ wie das „Windows-Updatefeature“ können von Microsoft jederzeit gesperrt werden (Punkt 7 der Lizezbedingungen). Dadurch existiert de facto kein Recht auf Security-Updates.
Ich habe mich für Ubuntu GNU/Linux entschieden, da dieses als Freie Software meine Rechte als Verbraucher ernst nimmt.
Ich bitte Sie deshalb, mir die Kosten für die Windows-Lizenz zurückzuerstatten und die erworbene Windows-Lizenz einzeln zurückzunehmen.
Weiterhin bitte ich sie die Software Power DVD 8.3 und Roxio 10.3 ebenfalls zurückzunehmen, da ich diese ohne Windows nicht nutzen kann.
Die selbe Anfrage habe ich auch zu dem Notebook, welches ich am 01.12.2010 erhalten habe gestellt und bis heute keine Antwort erhalten.
Für eine Antwort bis zum 07.01.2011 wäre ich Ihnen dankbar.

Falls Du jedoch keine Lust auf diesen Eiertanz haben solltest: Einfach alles komplett zurückgeben und den vollständigen Preis zurückverlangen. Zu diesem Schritt solltest Du auf jedem Fall bereit sein, sonst bist Du in einer sehr nachteiligen Verhandlungs- position.

Das ist ein schwieriges Thema. Ich versuche es mal zusammenzufassen, so wie ich es verstanden habe. Juristen mögen mich bitte korrigieren:
Die Weitergabe der Software wird Dir mit Sicherheit irgendwo im Kaufvertrag untersagt worden sein. Jedoch ist eine solche Klausel zumindest in Deutschland unwirksam. Solltest Du also jemanden finden, der Dir die Recovery-DVD abkauft, ist das vielleicht sogar rechtlich okay. Ein Käufer könnte zum Beispiel jemand sein, er ein älteres System hat, auf dem die DVD zufällig auch funktioniert. In dem Fall darfst Du natürlich _keine_ Kopie davon für Dich verwenden, aber das willst Du ja auch gar nicht.
Schwieriger wird es, wenn Du (oder jemand anderes) die Software von der Recovery-DVD heraus löst, um sie so auf einem völlig anderen System verwenden zu können. Einerseits darfst Du das natürlich, und eine Vertragsklausel, die Dir das verbietet, wäre unwirksam. Wenn Du also lediglich ein paar Installer-Dateien aus dem auf der DVD liegenden Festplatten-Image heraus kopieren musst, dann könnte das okay sein.
Wenn man jedoch mehr machen muss, als irgendwelche Dateien umher zu schieben, also zum Beispiel einige *.exe-Dateien patchen muss, dann dürfte das als Reverse-Engineering gelten. Und hier wird es kritisch. Natürlich wird Dir Reverse-Engineering, Disassembling, etc. erstmal vom Hersteller verboten. Aber die Frage ist auch hier, ob diese Klauseln wirksam sind.
Denn einerseits ist es durchaus erlaubt, Software zur Erhöhung der Interoperabilität anzupassen, auch und gerade gegen den Wunsch des Herstellers.
Andererseits könnte man das aber auch als Umgehung eines wirksamen Kopierschutz-Mechanismus auffassen, und das ist seit den letzten Urheberrechts-Verschärfungen verboten.
Aber wiegesagt, das ist nur mein persönlicher Kenntnisstand. Es wäre super, wenn auch ein Jurist noch etwas dazu sagen könnte.
Wenn ich mal zuviel Zeit habe, (Wird wohl wahrscheinlich nicht vor Freitag passieren) werde ich mir nochmal die Gerichtsurteile zu dem Thema durchlesen und schauen ob ich dazu nen kleinen Text schreibe. (Gute Hinweise sind natürlich erwünscht ;) )

Falls Du jedoch keine Lust auf diesen Eiertanz haben solltest: Einfach alles komplett zurückgeben und den vollständigen Preis zurückverlangen. Zu diesem Schritt solltest Du auf jedem Fall bereit sein, sonst bist Du in einer sehr nachteiligen Verhandlungs- position.
Also zurückgeben ist keine Option, aber das muss ja Dell nicht wissen ;)
Sie werden es spätestens dann mitkriegen, wenn Du das Produkt trotz Diskussion nicht zurück gibst. Und dann wissen sie, dass sie solche Forderungen auch weiterhin nicht ernst nehmen müssen. Das bringt Dich und andere zukünftig in eine schlechtere Position.
Andererseits ist es natürlich Deine Arbeitszeit, die dafür draufgeht. Nicht jeder hat die Zeit dafür, das Produkt demonstrativ unter großem Trara zurückzugeben.
Vorallem, wenn es wie in Deinem Fall nunmal gebraucht wird, und Du somit kurze Zeit später ein ähnliches Produkt unter anderem Namen trotzdem erwerben müsstest. :-)

Gute Frage. Ist es besser, wenn jemand Stress macht und sich dann zurück zieht, oder wenn niemand Stress macht?
Ich denke, Deine Aktion ist auf jeden Fall gut und vorbildlich, und ich wollte Dein Engagement auf keinen Fall damit schlecht reden. Ich wollte lediglich anregen, das auch komplett durchzuziehen, falls es Deine Zeit zulässt, weil die Aktion dann nochmals deutlich wirksamer wäre.
Je nachdem wie lange sich die Diskussion hinziehen würde, wäre für die Betroffenen nen neues Notebook evtl gar nicht so schlecht ;)

Da die Laptops nicht für mich bestimmt sind, kann ich das Leider nicht tun. Ich kann nicht einfach den anderen die Notebooks entreißen ;) Die jetzigen Besitzer der Notebooks werden die Notebooks wohl nur weggeben, wenn sie auch was davon haben. (z.B. neueres besseres Notebook usw.)
Ich habe das auch nicht als "schlecht reden" empfunden, sondern ich Frage mich das tatsächlich. Weil ich sowieso jemand bin, der oft mit dem Kopf durch die Wand geht ;) Ich brauche mir die ganze Mühe nicht machen, wenn ihr meint, dass es eher Kontroproduktiv ist. Allerdings würde ich eher sagen, dass es gut ist, weil somit die Arbeitszeit des Personals in Beschlag genommen wird ;)
