Nach eingehender Studie der GPL bin ich zu der Überzeugung gelangt, dass Sie mit der Distribution der Win32 .EXE Datei von DIPasDoc gegen die GPL verstoßen. Das ist jetzt nicht irgendwie "böse" gemeint, sondern soll nur ein Hinweis sein.
Daher sollten wir hier auch nicht darüber streiten. Die Gründe, warum ich DIContainers für DIPasDoc benutze, habe ich in der History dargestellt.
Kurze Begründung: Die GPL sagt in Abschnitt 3, dass bei einem GPL Programm welches "in object code or executable form" verbreitet wird der komplette Quelltext der zur Kompilierung benötigt wird unter GPL verfügbar sein muss, und zwar zum Selbstkostenpreis [1].
Außerdem heißt es:
However, as a special exception, the source code distributed need not include anything that is normally distributed (in either source or binary form) with the major components (compiler, kernel, and so on) of the operating system on which the executable runs, unless that component itself accompanies the executable.
Wenn ich nun DIContainers also "major component" begreife, dann würde DIPasDoc die GPL dennoch einhalten. Doch das jetzt dezidiert auseinanderzusezieren wäre, glaube ich, reine Wortklauberei.
Da die Distribution jetzt schon geschehen ist, sehe ich eine einfache Möglichkeit die Verletzung "aufzuheben": Die Veröffentlichung der für DIPasDoc benötigten Teile von DIContainers unter GPL. Davon würde der Verkauf von DIContainers ja nicht berührt, da die veröffentlichten Teile nur in GPL Projekten einsetzbar wären. Einen ähnlichen Weg hat Borland ja mit der RTL von Kylix schon eingeschlagen. Ich kann auch verstehen, dass Ihnen das nicht ganz lieb ist. Eine andere Möglichkeit wäre die Notwendigkeit DIContainers zu verwenden aus DIPasDoc zu entfernen, das hab ich bereits versucht bin aber nicht sehr weit gekommen, da ich das Verhalten von DIContainers überhaupt nicht kenne.
Es wird Ihnen auch ansonsten nicht leicht fallen, da Sie die Funktionalität von DIContainers in Form und Leistungsfähigkeit nicht finden werden. Daher hat DIContainers durchaus seine Berechtigung.
Eine dritte und vierte Möglichkeit haben Sie übrigens nicht aufgeführt: Die GPL rauszuschreiben oder die Entwicklung von DIPasDoc einzustellen. Einmal ganz ehrlich: DIPasDoc voranzutreiben kostet Arbeit, Zeit und Nerven. Bevor ich mir das Leben zusätzlich schwer mache, indem ich die leistungsfähigste Containerbibliothek für Delphi nicht verwende, kann ich das Projekt eigentlich auch rein privat weiterentwickeln und nutzen. Wenn Sie die History einmal auf die Qualität -- nicht die Quantität -- externer Beiträge abklopfen, werden Sie vielleicht verstehen, was ich meine.

Die Einhaltung der GPL ist schon aus rein formaljuristischen Gründen erforderlich. In einer Verletzung, wie dem vorliegenden Fall, wird die Lizenz nämlich ungültig. D.h., der Anwender hat keine gültige Lizenz und eine Verwendung von DiPasDoc wäre somit illegal. - Unlizensierte Softwarem, die BSA nennt sowas eine "Raubkopie".
Wenn ich richtig verstehe, ist DIPasDoc eine Erweiterung von PasDoc? Das würde bedeuten, dass DIPasDoc mit der Erweiterung und der Anbindung an DIContainers das Urheberrecht des ursprünglichen Autors verletzt.
Das Argument, DIContainers sei eine "major component" im Sinne der Ausnahme, ist nciht stichhaltig, da die Bibliothek ja nicht im Lieferumfang des Betriebssystems oder Compilers ist und auch keine entsprechende Funktion erfüllt.
Einziger Ausweg wäre eine explizte Erlaubnis des ursprünglcihen Autors, seinen GPL-lizenzierten PasDoc-Code mit DIContainers zu linken. Alles andere ist illegal.

So ist es. Als nächstes sollte der Entwickler von PasDoc informiert werden, dass sein Code in einem teilweise proprietären Programm (das ist DIPasDoc nämlich) verwendet wird, und dass damit sein Urheberrecht verletzt wird.
Bezüglich seinem eigenen Code kann Ralf Junker im Prinzip machen was er will. Zu sagen der Code stehe unter der GPL und dann den Sourcecode selber nicht zur Verfügung zu stellen ist im Prinzip reine Vera****ung und zeigt höchstens, dass man die GPL nicht verstanden hat. Praktisch hat es die Auswirkung, dass niemand auf der Welt DIPasDoc weitergeben darf als der Autor selber.
Wie gesagt, bezüglich des Codes den er nicht selber geschrieben hat muss der Autor "einschreiten", denn es sind _seine_ Rechte, die verletzt werden. Bleibt zu hoffen, dass der ursprüngliche Autor ein besseres Verständnis für die GPL und für Freie Software hat.

Die leider sehr oft gehörte "sei doch froh, dass ich überhaupt was mache, kriegst es eh geschenkt, was regst dich denn auf" Mentalität. :-(
Oder - in anderen Worten - genau einer der Punkte, wodurch sich die "Freie Software"-Mentalität (positiv) von der "Open Source"-Mentalität abhebt.

Aber jetzt mal rein formaljuristisch: Habe ich nicht theoretisch schon mit ihm einen Vertag geschlossen? Auf der Homepage von DIPasDoc steht unter "download":
"The package includes the compiled DIPasDoc console application as well as the component and application Source Code subject to the GNU General Public License."
Durch das Herunterladen dieses Package habe ich (m.E.) mit dem Autor Ralf Junker einen Vertrag geschlossen, dessen Bestandteil die GPL wird (?). Dieser Vertrag enthält dann, dass die kompletten Quelltext mitgeliefert werden. Das kann man ja soweit auch noch denken, wenn man den Absatz auf der Homepage gelesen hat. Mithin liegt eine Vertragsverletzung vor, wenn er mir nicht den kompletten Quelltext nach GPL (Vertrag) zum Selbstkostenpreis der Weitergabe unter GPL überlässt.
Wie gesagt: Rein theoretisch. Ich werde jetzt wohl nicht versuchen das einzuklagen.
Ich werde jetzt als nächstes mal Marco Schmidt benachrichtigen, und evtl. einmal mit jemandem sprechen der sich mit Privatrecht besser auskennt als ich :)

Kurz zu dem Thema "Vertrag":
Anders als wohl in den USA ist auch bei uns jede Lizenzierung ein Vertrag. Es ist allerdings zwischen den folgenden Vertragsverhältnissen zu unterscheiden:
1. GPL Die GPL erzeugt zwischen allen Urhebern (bzw. Rechteinhabern) des ihr unterstellten Programms Lizenzverträge (=Einräumung von Nutzungsrechten) mit demjenigen, der diese Software nutzen will (d.h. verbreiten, kopieren etc.). Nutzen heißt nicht "benutzen" (s.u.). Dieser Vertrag betrifft nur die Rechte an der Software, nicht die Software selbst. Die durch die GPL eingeräumten Rechte werden dabei verschenkt (die Schenkung selbst ist nach deutschem Recht ein Vertrag). Es wird also zwischen dem schuldrechtlichen Vertrag "Schenkung" und dem Vertrag "Nutzungsrechtseinräumung" unterschieden (vergleichbar mit dem Kauf eines Computers: Ich schließe den Kaufvertrag mit Media Markt abs und einen weiteren Vertrag für die Eigentumsübertragung des Computers - der auch mit Dritten, etwa dem Computerhersteller abgeschlossen werden kann).
2. Download Durch den kostenlosen Download wird die Software selbst verschenkt, also ein eigener Vertrag geschlossen. Je nachdem wie der Download gestaltet ist, kann es sein, dass gleichzeitig auch ein Vertrag (Schenkung) über die Nutzungsrechte stattfindet, selbst wenn die Erfüllung (Nutzungsrechtseinräumung) durch Dritte erfolgt (GPL, s.o.). Enthält der Download keinen Hinweis, kommt zunächst nur ein Vertrag über die Software selbst zustande, so dass zu diesem Zeitpunkt nur die "Benutzung" (Ablaufenlassen) Vertragsgegenstand ist. Wenn ich dann die GPL "entdecke" und die Software weiterverbreite, kommt damit der unter 1. beschriebene Vertrag über die Nutzungsrechte mit den Rechteinhabern zustande.
Ergo: Verspricht mir ein Webseitenbetreiber GPL-Software, kann es sein, dass er den Schenkungsvertrag mit mir verletzt, wenn er bewusst die GPL verletzt. Ansonsten begeht er *mir gegenüber* keine Vertragsverletzung. Allerdings verletzt er dann den Lizenzvertrag mit den Urhebern der Software, die ihm die urheberrechtliche Erlaubnis zur Weiterverbreitung der Software nur unter den Bedingungen der GPL gestattet haben. Ihnen gegenüber ist er "Raubkopierer" und kann rechtlich belangt werden.

Im vorliegenden Fall verspricht [1] meiner Meinung nach der Webseitenbetreiber nun GPL-Software, scheint aber der Auffassung zu sein, dass er die GPL nicht verletzt (auch wenn es eigentlich klar zu sein scheint, dass er es tut).
Aber mal angenommen er verletzte bewusst die GPL (ich bin jetzt irgendwie mehr an der Sache interessiert als diesem Spezialfall), könnte er dann nicht argumentieren, dass er die versprochene Leistung nie komplett bewirkt hat (da er mir nicht die kompletten nach GPL versprochenen Quelltexte übermittelt hat), und damit der Schenkungsvertrag nichtig ist, da der Mangel der Form nur durch Bewirkung geheilt wird? Oder würde man eher sagen dass die versprochene Leistung zu einem genügen großen Teil bewirkt wurde um diesen Mangel zu heilen? Oder noch was völlig anderes?

Danke für die klare Darlegung der deutschen Verhältnisse, mir war es nur für die USA bekannt.
Es ist allerdings zwischen den folgenden Vertragsverhältnissen zu unterscheiden:
- GPL

Nein. Definitiv nicht. Die GPL regelt nicht die Verwendung der Software, sondern lediglich die Weitergabe. Die Verwendung von GPL-Software unterliegt keinen Beschränkungen.
Du würdest die GPL verletzen, wenn du DIPasDoc in binärer Form weitergeben würdest.
Aber jetzt mal rein formaljuristisch: Habe ich nicht theoretisch schon mit ihm einen Vertag geschlossen?
Ja. Der Vertrag erlaubt dir die uneingeschränkte Verwendung der Software sowie die Weitergabe der Software unter der Bedingung, dass du den vollständigen Sourcecode mitlieferst. Da du diese Bedingung nicht erfüllen kannst, verbietet dir also praktisch die GPL die Weitergabe des Programmes.
Ich werde jetzt als nächstes mal Marco Schmidt benachrichtigen, und evtl. einmal mit jemandem sprechen der sich mit Privatrecht besser auskennt als ich :)
Ich würde die weitere Vorgehensweise von der Reaktion von Marco Schmidt abhängig machen. Falls es ihm "wurscht" ist, ist eigentlich Hopfen und Malz verloren, denn dann könnte er seine Software genauso auch unter eine BSD-Lizenz stellen. Dann kannst auch du nichts mehr sinnvolles tun (ausser vielleicht das Program boycottieren - wie jedes andere proprietäre Programm).
Falls er allerdings etwas unternehmen will, wendet er sich am besten direkt zuerst an den "Täter" und falls auch dort nichts herauskommt an diese Liste (oder an team@fsfeurope.org).
