nachdem die Übersetzung jetzt ziemlich fertig aussieht, wollte ich mal ein paar Dinge ansprechen, die mir in dem Booklet aufgefallen sind. Es gab ein paar Ungereimtheiten in dem Text und ich fand, die Argumentation war nicht immer ganz schlüssig. Ich will das jetzt nicht hier breittreten, zumal ich annehme, dass der Text nicht die Arbeit einer Einzelperson, sondern einer ganzen Gruppe ist und diese Inkonsistenzen daher kommen. Bei Bedarf kann ich aber einige Beispiele nennen.
Meine Frage wäre jetzt, ob es eine Chance gibt, den Text zu überarbeiten, damit zum Beispiel faktische Fehler korrigiert werden und ein paar sprachliche Unstimmingkeiten (im Originaltext) behoben werden. Ich finde der Text enthält nämlich viele gute Argumente, ist aber leider stellenweise etwas verwirrend.
Ich wäre auch gerne bereit zu helfen.

Ok, aber der Auftrag war ja eine Übersetzung und die Übersetzung sollte ja die Meinung der ursprünglichen Autoren wiedergeben, daher die Frage. Also werde ich zumindest eine eigene Datei anlegen. Ich frage mich nur ob das deutsche Booklet nur von der FSFE herausgegeben wird (dann wäre eine überbeitete Fassung wahrscheinlich denkbar) oder wie das Original von verschiedenen Gruppen zusammen und dann kann ich hier nicht einfach kommen und eine neue Fassung erstellen.

Wenn die FSFE von "Digitaler Rechteminderung" spricht tut sie den DRM-Herstellern einen Gefallen. Ich sehe die Gefahr, dass Nutzer die der FSFE vertrauen im vorauseilenden Gehorsam auf die Ausübung ihrer Rechte verzichten könnten, genau wie das bereits heute teilweise der Fall bei Privatkopien ist.

Rein vom Schriftbild finde ich sieht "Digitale Rechteminderung" schöner aus, aber ansonsten habe ich dazu keine starke Meinung.
Ich möchte aber darauf hinweisen, dass wir bisher die zusammen geschriebene Variante verwendet haben und es so auch in der Wortliste[1] steht. Wir sollten also zumindest eine Entscheidung treffen und dann wenn nötig die Wortliste aktualisieren.

Das schöne an der deutschen Sprache ist, dass sie die Zusammensetzung zwei Wörter zu einem neuen eben auch *ohne* Koppelungszeichen erlaubt. Der Bindestrich soll bei Wortzusammensetzungen vor allem der Lesbarkeit dienen – speziell wenn mehr als zwei Worte ein neues bilden. Nach der neuen deutschen Rechtschreibung darf er allerdings auch schon bei Zusammensetzungen aus zwei Worten verwandt werden (nach der alten: vier).
Rein vom Schriftbild finde ich sieht "Digitale Rechteminderung" schöner aus, aber ansonsten habe ich dazu keine starke Meinung.

Nach Regel K22 des Duden darf der Bindestrich in unübersichtlichen Zusammensetzungen stehen. Das ist hier m. E. n. angebracht.

Ich plädiere also für Digitale-Rechte-Minderung - unabhängig davon, ob in einer früher aufgestellten Wortliste es anders stehen mag. DRM ist schlagkräftig (im wahrsten sinne), also sollte es eine aufrüttelnde Übersetzung ins Deutsche auch sein.

Ich kann es zumindest versuchen.

Viele DRM-Variationen fallen beim Kopieren des für den Nutzer relevanten Inhalts überhaupt nicht auf, wenn man nicht explizit danach sucht (und überhaupt weiß wie man sie erkennen kann).
Mir sind keine Urteile bekannt, die besagen würden, dass derartige DRM-Variationen die Anforderungen von UrhG § 95a erfüllen würden und somit nicht ohne Zustimmung des Rechteinhabers umgangen werden dürfen. Teilweise ist sogar unklar ob der Kopiervorgang rechtlich überhaupt eine Umgehung darstellt.
Selbst in Fällen wo die DRM-Variation beim Kopieren umgangen würde und rechtlich nicht umgangen werden darf, halte ich es für unpassend von Rechte-Minderung zu sprechen, da es voraus setzen würde, dass das Recht zu kopieren einmal vorlag.
Ich sehe nicht, wie das in vorauseilenden Gehorsom enden soll. (z.B. bei dem Booklet https://fsfe.org/news/2012/news-20120831-01.de.html..)

Solange keine Urteile zu den rechtlichen Auswirkungen von DRM-Variationen auf Film-DVDs vorliegen, halte ich es für vorauseilenden Gehorsam eine rechtliche Auswirkung als Fakt darzustellen.
Meiner Meinung nach kann man die Nachteile von DRM darstellen ohne den Leser zu täuschen.

Also da würde ich schon teilweise widersprechen. In einer weitläufigen Auslegung des Begriffs DRM gehört dazu natürlich auch beispielsweise ein Kopierschutz auf Audio-CDs und der fällt in vielen Fällen wirklich kaum auf, aber die anderen DRM-Systeme wie z.B. bei e-Books und digitalen Filmen, fällt sehr wohl auf. Wenn ich eine BluRay auf dem PC sehen will, muss ich ganz bestimmte Software nutzen und wenn ich sie auf den PC kopieren möchte, geht das gar nicht. Die einzigen Nutzer, die nie was davon merken sind die, die ihre z.B. online gekauften Filme nie von einem PC zum nächsten übertragen und ihren PC nie neu installieren. Auch bei Videospielen ist das ähnlich. Beim 3DS kann man die gekauften Inhalte nur fünf Mal auf eine andere Konsole überspielen, dann ist Schluss. Und selbst wenn es geht, ist es viel umständlicher als wenn man die Daten einfach kopieren könnte. Also bemerkt man das alles sehr wohl.
[§ 95a UrhG und vorauseilender Gehorsam] Man muss hier zwei Argumente trennen. Das erste Argument ist, dass man normalerweise z.B. Filme und Bücher verleihen darf und es auch kann, aber sobald diese in digitaler Form mit DRM vorliegen, wird es faktisch erst einmal unterbunden. Gerade technisch nicht so versierte Menschen haben dann ein Problem, weil sie in ihren Möglichkeiten und Rechten eingeschränkt werden. Dabei geht es noch nicht um Gesetze, sondern nur um die tatsächlichen Möglichkeiten.
Das zweite Argument ist, dass die Umgehung von Kopierschutzmaßnahmen illegal ist. Erst hier geht es auch um Gesetze. Wenn ich mich recht entsinne, wurden sogar Kopierschutzmaßnahmen auf CDs, die nur unter Windows greifen, als wirksam eingestuft. Also dürfte das bei härterem DRM erst recht der Fall sein. Aber selbst wenn es keine Präzedenzfälle gibt, ist es ein untragbarer Zustand, dass Bürger eventuell rechtlich belangt werden könnten, nur weil sie ein technisches System aushebeln, das verhindert, dass sie ansonsten legale Dinge tun. Ohne Präzedenzfälle hat man nämlich auch keine Rechtssicherheit im positiven Sinne, denn jedes Gericht kann anders entscheiden und oft genug passiert das auch. Die eigene Sicherheit hängt damit vom Kenntnisstand und der Willkür eines Richters und damit auch vom Zufall bzw. der Wahl des Gerichtsstands ab. Das zweite Argument richtet sich hiergegen. Und zumindest die Intention des Gesetzes ist ja auch klar: Einen technischen Kopierschutz darf man nicht umgehen, auch wenn er unwirksam ist. Denn ansonsten wäre das Gesetz inhaltlos, denn jeder Kopierschutz, den ich umgehe, ist damit auch unwirksam und wäre dann streng genommen nicht mehr geschützt, also wäre überhaupt kein Kopierschutz rechtlich geschützt.
Ich denke nicht, dass das in vorauseilendem Gehorsam enden wird. Hinter verschlossenen Türen tun Menschen, die wissen wie sowieso was sie wollen und die, die es nicht wissen, tun sowieso nichts. Wir beklagen nur, dass und Unternehmen Möglichkeiten nehmen.
Selbst in Fällen wo die DRM-Variation beim Kopieren umgangen würde und rechtlich nicht umgangen werden darf, halte ich es für unpassend von Rechte-Minderung zu sprechen, da es voraus setzen würde, dass das Recht zu kopieren einmal vorlag.
Ja, es gibt kein Recht auf Privatkopie im juristischen Sinn. Recht kann aber auch Bürgerrecht bzw. Menschen- oder Freiheitsrecht meinen und ich habe das immer eher so aufgefasst, da die FSF(E) für soziale Veränderung steht und nicht von einem konkreten Rechtssystem aus argumentiert. Die Forderungen sind also allgemeiner als spezifische Gesetze.

Korrekt, aber erstens ist es auch hier wieder sehr knifflig zu bestimmen was offensichtlich rechtswidrig ist (wird ja eventuell doch noch im Fall kino.to(?) geklärt) und zweitens geht es uns auch hier wieder um die Möglichkeit tatsächlich zu kopieren und das Bürgerrecht mit den Bits auf meinem Computer zu tun, was ich will, nicht um ein konkretes Gesetz.
Glaubwürdigkeit finde ich deutlich wichtiger als die (subjektive) "Sperrigkeit" der Begriffe. Zudem wird der Begriff die meiste Zeit über abgekürzt.
Da stimme ich dir zu. Ich sehe nur wirklich keine Täuschung. Die Intention der Gesetze ist klar und wie streng solche Gesetze ausgelegt werden, sieht man auch an Fällen, in denen es nicht um DRM geht. Die vielen Fälle, in denen Tauschbörsen-Logs der Rechteverwerters als Beweis gewertet werden und der Fall mit der Rentnerin, die Musik getauscht haben soll obwohl ihr Internet-Anschluss ungenutzt (und bereits abbestellt, aber noch aktiv) war, sprechen für sich. Vielleicht haben wir Glück und es wird alles doch ganz anders, aber ich denke nicht, dass wir Menschen hier täuschen.

Ja, es gibt kein Recht auf Privatkopie im juristischen Sinn. Recht kann aber auch Bürgerrecht bzw. Menschen- oder Freiheitsrecht meinen und ich habe das immer eher so aufgefasst, da die FSF(E) für soziale Veränderung steht und nicht von einem konkreten Rechtssystem aus argumentiert. Die Forderungen sind also allgemeiner als spezifische Gesetze.

Personally, I dislike that we are singling out Apple. I understand that others do not agree, but the actions of Apple are not different from those of TiVo, Microsoft, Google or others. In my opinion, what Google does with Android damages Free Software more than what Apple does with it's proprietary OS.
I suggest not naming any company, it also shines a bad light on us.

We considered this when drafting the original text. In most FSFE communication, we're quite careful about naming companies - we do it only when necessary.
The booklet's intended audience are people who aren't very interested in or knowledgeable about technology. In order to reach them, we need concrete examples. That means naming names.
I'd be very happy if we can find examples for DRM in widespread consumer products that are made by companies other than Apple. If we can, let's use them to replace some of the Apple examples.
But we need products that are common in Europe, hence TiVo is out. If we want to say "the device that you're holding in your hand today sucks, because...", then the various iDevices are hard to beat as examples.
Can we find others?
That said, I don't agree that naming companies shines a bad light on FSFE. Sometimes a company does something wrong, and then it's our job to say so. We do this in a professional and serious fashion, but we still do it.
