Ja, ich wollte die Diskussion lieber hier führen, um mehr Meinungen dazu hören zu können.
Dazu sage ich: Jeder kann sein Zeug so lizenzieren wie es ihr beliebt. Aber wenn zB. Modifikation ausgeschlossen ist, dann sollte das ganze nicht unter dem Banner freies Wissen/Kultur laufen.
Derzeit würde ich auch Dinge unter freies Wissen/Kultur packen, die nicht modifiziert werden können. Es kommt auf die Art des Werkes an.
Ich finde hier Richard Stallmans Einteilung ganz gut:
I propose a classification broadly into three kinds of works: functional works, works that express personal position, and works that are fundamentally aesthetic.

Also eine Aufteilung in:
- /funktionale Werke/: Computer Programme, Rezepte, Wörterbücher, Lehrbücher und andere Referenz-Werke. - /Werke die persönliche Meinungen oder Erfahrungen wiedergeben/: Aufsätze, Angebote, rechtliche Statements, Memoiren, alles wo es darum geht was jemand denkt, will oder mag. - /ästhetische Werke/: Geschichten, Gedichte, in vielen Fällen Zeichnungen und die meiste Musik.
Diese Werke werden alle unterschiedlich genutzt.
Funktionaler Werke sehe ich wie Stallman auch nicht als Frei an, wenn diese nicht modifiziert werden können. Aber warum sollte es bei Werken der persönlichen Meinung oder Erfahrung notwendig sein, dasss modifizierte Versionen gemacht werden können? Wörtlichenes Kopieren und nicht-kommerzielle Weiterverbreitung reichen hier doch. Modifikation könnte sogar schlecht sein: Bei wissenschaftlichen Arbeiten kann Veränderung schlecht für die Gesellschaft sein da die Falsifizierbarkeit erschwert wird.

Dem kann ich zu 100% zustimmen. Jeder soll seine Werke lizenzieren dürfen, wie er möchte - auch proprietär. Jedoch bin ich für eine Abänderung des Urheberrechts (Starke Kürzung der Ablauffristen, Einführung von Fair Use auch in der EU, ...), aber das ist ein anderes Thema.
Was Creative Commons angeht, verfolgen sie aber einen etwas anderen Ansatz als die freie Kulturszene. Sie gehen von der "normativen Kraft des Faktischen" aus, sprich: Digitale Inhalte lassen sich quasi kostenlos verlustfrei kopieren und dies wird auch gemacht - ob es nun erlaubt ist, oder nicht ("Piraterie!!!!"). Sie sagen sich also: "Lasst uns diese Tatsache akzeptieren und die Potentiale statt der Gefahren darin erkennen und für uns nutzen, anstatt etwas zu verteufeln, das sich sowieso nicht verhindern lässt."
Damit mich niemand falsch versteht: Ich finde es gut, dass es diese NC- und ND-Lizenzmodelle gibt. Aber so lizenzierte Inhalte haben mit "Free Content" und freier Kultur nur sehr wenig zu tun und sie sollten sich nicht mit dem Erfolg der freien Kultur schmücken. Besonders die NC-Inhalte sehe ich sehr problematisch, da es hier entweder um eine Werbeverbreitung proprietärer Inhalte geht (wunderbar, aber hat mit freier Kultur nichts zu tun) oder es sich um reine Hobby-Werke (nicht als Beschimpfung anzusehen) wie z.B. das Blog netzpolitik.org handelt.
Aus den folgenden Gründen kann ich NC-lizenzierte Inhalte beim besten Willen einfach nicht als frei betrachten:
1. Eines der faszinierendsten Dinge an FOSS, welches letztendlich auch maßgeblich deren Erfolg begründet, ist meiner Meinung nach der inzwischen fließende Übergang von bezahlten, "professionellen" Entwicklern und welchen, die das "nur mal so" als Hobby tun bzw. kompetenten Usern, die einen nervenden Bug oder ein Sicherheitsleck in einer Software einfach selbst entfernen können. Daher ist die - aufgrund ihrer Essenzialität von Stallman mit 0 nummerierte - Verwendungsfreiheit die Basis für eine freie Wissensgesellschaft, die über von der Kostenlos-Mentalität geprägte Communitys hinausreicht.
2. NC ist eine Einbahnstraße: Einmal als NC lizensiert und oft genug remixed kann der Inhalt nie wieder kommerziell verwertbar werden, da es quasi unmöglich ist, die ganzen Urheber zwecks einer Relizensierung ausfindig zu machen. Geniale Projekte wie POV-Ray stehen zur Zeit genau vor diesem Problem. Insofern halte ich CC-ND- und CC-ND-NC-Lizenzen für unproblematischer als CC-NC und CC-NC-SA. Das frappante an der ganzen Geschichte ist, dass eine NC-Lizensierung sogar dem ursprünglichen Urheber selbst auf die Füße fallen könnte, wenn er mit oft remixten Inhalten von sich Geld verdienen möchte.
3. "Kommerzielle Nutzung" ist schwammig: Selbst ein einziger Werbebanner auf meinem Blog macht mir die legale Einbindung von NC-Inhalten unmöglich. Ein gemeinnütziger Verein zum Beispiel, der durch den Verkauf einer CD mit freien Inhalten Spenden sammeln will, kann das nie tun, wenn dort NC-Inhalte darauf sind. Das NC-Attribut schränkt somit die Verbreitung der Inhalte massiv ein - was wohl in der Regel nicht im Sinne des Urhebers sein sollte.
4. NC-Inhalte können nie den Weg auf eine "Truely Open Source"-Distribution finden, die z.B. den Debian-Free-Software-Guidelines unterliegt.
5. Ausbeutung quasi nicht möglich: Wohl einer der Hauptgründe, die Nutzer zu einer NC-Lizensierung treibt, ist vermutlich die Angst vor kommerzieller Ausnutzung ihrer Inhalte. Doch warum würde jemand für etwas Geld bezahlen, das er auch kostenlos vom ursprünglichen Urheber bekommen könnte, wenn der Verwerter den Inhalt nicht - in welcher Form auch immer, sei es durch Dienstleistung oder zusätzliche Beigaben - entsprechend aufgewertet, veredelt hätte? Hat er das getan, ist es dann nicht auch legtim, wenn er dafür etwas bekommt - zumal er damit ja auch für den ursprünglichen Inhalt Werbung macht?

Möller geht in seinem Artikel ja meist auf Wikipedia ein, was ganz klar ein funktional Werk darstellt. NC macht ein funktionales Werk unfrei (ich glaube hierin waren sich alle bisherigen Teilnehmer der Diskussion einig).
Aber warum sollte es bei Werken der persönlichen Meinung oder Erfahrung notwendig sein, dass modifizierte Versionen gemacht werden können? Wörtliches Kopieren und nicht-kommerzielle Weiterverbreitung reichen hier doch.
Mag sein, aber das hat, wie oben dargelegt, eben mit freier Kultur nur sehr wenig zu tun.
Warum hat es nichts mit freier Kultur zu tun, wenn Artikel unter einer Lizenz stehen, die es jedem ermöglichen diesen Artikel zu lesen, ihn an andere kostenlos weiterzugeben und zu diskutieren und evtl. einen Artikel dagegen zu stellen? Meiner Ansicht nach trägt der Autor des ursprünglichen Artikels sehr viel zu unserer Kultur bei. Ein Essay ist ein anderes Werk als Dokumentation. Ich sehe für mich keinen Verlust an Freiheit, wenn ich den Ursprungsartikel nicht abändern darf. (Zitiern darf ich so oder so und das reicht mir vollkommen.)
Und warum sollte ein Band die ihre Lieder unter eine CC-NC-ND nicht unter freier Kultur laufen? Ich kann die Muisk hören, ich kann sie mit Freunden hören, ich kann sie weitergeben. Nimmt es dir als "Benutzer" Freiheit, dass du nicht die E-Gitarrenspur rausnehmen kannst und danach weitergeben? Oder nimmt es dir als "Benutzer" deine Freiheit (im Verhältnis zu der Freiheit des Autors), wenn du das Lied nicht auf deine mit Werbung vollgepflasterte Webseite stellen darfst???
Bei Dokumentation nimmt es mir Freiheit! Bei Software nimmt es mir Freiheit! Bei einem Lexikon nimmt es mir Freiheit. Das sind aber alles funktionale Werke.
(Versteht mich nicht falsch, ich finde die mag die NC Lizenzen nicht. Und ich glaube in den meisten Fällen schaden sich die Autoren und Künstler damit -- z.B. glaube ich auch, dass die Verbreitung der Inhalte durch NC nicht so stark ist, wie sie sein könnte. Trotzdem finde ich, dass es mir als "Benutzer"/"Anwender"/"Konsument" in vielen Fällen außerhalb funktionaler Werke keine Freiheit nimmt.)

*-NC und *-ND Sachen nehmen wir zB. in SuperTuxKart nicht auf. Hilft uns nix, wenn wir die Sachen zwar auf die Website packen könnten, dann aber später Fedora und Debian ihre Pakete zB. ohne Musik ausliefern ...
Von daher können von mir aus *-NC Sachen unter kostenloser/gratis Kultur laufen, aber nicht unter freier.

Wenn du etwas in Software integrieren willst, dann ist es ja wieder ein funktionales Werk. Bei funktionalen Werken sind NC und ND klar unfrei.
Doch nicht jedes Werk ist ein funktionales Werk und nicht nur funktionale Werke sind Kultur. Deshalb bin ich der Ansicht, dass auch manche Werke unter einer Lizenz, welche keine Modifikation oder auch keine kommerzielle Nutzung erlauben, unter freie Kultur gefasst werden können.
(Nebenbei, sprach ich oben auch von "Benutzern", wohingegen du bei obigem Beispiel selbst Autor/Künstler eines Werkes wirst. Bei Freier Softwarer geht es ja auch mehr um die Freiheit des _Benutzers_ als die Freiheit des Autors.)
Noch ein paar Anmerkungen:
Wenn ich z.B. eine schöne Geschichte schreibe und sie unter eine "wörtliches Kopieren" / "ND" Lizenz stelle. Der Leser, kann sich die Geschichte auch umschreiben und den coolen Namen Spider Jerusalem überall in Kübelböck umändern. Nur darf er es danach so nicht weiter verbreiten. Warum sollte das nicht legitim sein? Ich will nicht, dass meine coole Hauptperson Kübelböck heißt. Und was hätte es mit freier Kultur zu tun, dass jemand den Namen meiner Hauptperson umändern darf?
Oder ich habe einen Anti-Kriegs-Film gedreht und jemand ändert einfach den Schluss und auf einmal wird mit dem Film der Krieg verherrlicht.
Oder ich habe mit meiner Band einen Song gemacht gegen Rassismus, jemand ersetzt die Tonspur mit gewaltverherrlichendem Text.
Wird derjenige der meine Text hört, dadurch in seiner Freiheit beeinträchtigt, wenn es nicht erlaubt ist, den Film oder das Lied zu ändern? Ist der Einschnitt so groß, dass es gerechtfertigt wäre von den Autoren zu fordern, dass ihre veränderbar sein sollen? (Bei funktionalen Werken fordere ich das von den Autoren.)

Hallo! So dann will ich auch mal meine Meinung zu dem Thema kundtun:
Ich finde die Unterteilung in funktionale Werke, "Meinungswerke" und Unterhaltungswerke / ästethische Werke nicht vollst. logisch. Dennoch glaube ich, dass es für ein Organ wie die FSFE richtig ist, nach außen diese Ansicht zu vertreten, da es für unterschiedliche Kämpfe unterschiedliche Verbündete gibt und es unter den gegebenen Umständen m.E. sinnvoller, also effektiver ist, Freiheiten Schritt für Schritt zu erkämpfen, als zum "Frontalangriff" zu blasen (also auf jeden Fall für Lobbyorganisationen wie die FSFE).
Warum die Unterteilung der Werke oder zumindest das Anwenden unterschiedlicher Regeln auf sie m.E. falsch ist: Alle diese Werke haben die Gemeinsamkeit durch Information representiert zu werden, d.h. Reproduzierbarkeit und Veränderbarkeit ist heutzutage ohne Kosten möglich. Da wir in einer Gesellschaft leben, die auf der ausbeutirschen Produktion von Waren und deren Konsum aufbaut, muss der Information ein warenförmiger Charakter aufgzwungen werden. Das passiert durch rechtliche und/oder technische Einschränkungen (DRM) der Verbreitung oder Veränderung. So kann man dann die nicht frei angebotenen Möglichkeiten, dann noch als Quasi-Produkte veräußern. Eine der Gesellschaft eigentlich zur Verfügung stehende Resource, die Information, wird künstlich verknappt, um an der Nachfrage verdienen zu können.
Betrachten wir die Unterscheidung funktionelle Information <-> ästhetische Information:
Auf den ersten Blick mag das logisch klingen, ein Programm macht irgendwas, ein Bild kann man nur angucken. Aber in den meisten Fällen ist die Unterscheidung doch garnicht so einfach. Betrachten wir eine Geschichte, die eine Großmutter ihrer Enkelin erzählt. Für das Kind mag die Geschichte unterhaltender Natur sein, die Großmutter will dem Kind aber vielleicht durch die Geschichte etwas beibringen, womit die Geschichte ein lehrendes Werk, ähnlich einem Schulbuch und damit funktional wäre, oder nicht? Sollte die Gesellschaft diese Unterscheidung nun machen? Oder sagt die Gesellschaft: Geschichten sind Unterhaltung und vergibt das Recht Geschichten mit -nc-nd zu versehen? Wäre das wünschenswert? Dann darf diese Geschichte nur im Wortlaut verlesen werden und auch nicht von der Babysitterin, denn die verdient schließlich Geld! Es gibt viele Beispiele die Subjektivität dieser Unterscheidung zeigen... vielleicht ist ja für einen Mathematiker ein Algorithmus wesentlich ästethischer als ein Bild von Picasso oder ein Lied von Rammstein.... Zurück zu einem Beispiel von vielleicht momentan größere Bedeutung: Warum sollte eine Band -nc-nd auf ihr Werk vergeben können? Warum genau ist die "Gitarrenspur" heiliger als ein Algorithmus in meinem Programm? Warum profitiert die Gesellschaft nicht von Remixen von Musik? Warum darf es nur einen Director's Cut von einem Film geben und nicht auch einen Hannes' Cut? Vielleicht wäre der ja besser!?

Genausowenig wie //du// die Software von jemand anderem veränderst, ändert //er// den Namen //deiner// Hauptperson! Er erstellt wenn dann ein derivates Werk von deinem, indem die Hauptperson Kübelbock heißt. Die Spider Jerusalem-Story wird es ja danach genauso von deiner Homepage zum runterladen geben. Ob auf www.dieTollstenGechichten.de dann deine Geschichte oder seine Platz1 wird hat ja nur damit zu tun was in der Gesellschaft (oder besser gesagt im Nutzerkreis der Seit) besser ankommt. Vielleicht wird seine Geschichte ja auch beliebter und du bekommst nur alle drei Wochen Fanpost, während bei dem Kübelbockautor die Frauen schlange stehen... Tja, so ist das halt. Die Gesellschaft hat von deiner Geschichte trotzdem mehr profitiert, als wenn sie -nd gewesen wäre.
Oder ich habe einen Anti-Kriegs-Film gedreht und jemand ändert einfach den Schluss und auf einmal wird mit dem Film der Krieg verherrlicht.
Oder du adaptierst einen Kriegsverrlichenden Film zu einem Anti-Kriegsfilm... Das ist doch genauso wie mit Software. Wenn ich ein SIcherheitstool schreibe, damit sich die Bürger gegen Staatsüberwachung schützen können, kann es auch sein, dass das Militär das nimmt um seine Soldaten in seinen Angriffskriegen vor "feindlicher" Spionage zu schützen.
Oder ich habe mit meiner Band einen Song gemacht gegen Rassismus, jemand ersetzt die Tonspur mit gewaltverherrlichendem Text.
s.o. Gerade bei solchen Werken muss einem doch die Funktionalität des ästhethischen ins Auge springen, oder nicht?
Zuletzt will ich noch auf die Meinungswerke eingehen:
Das einzige Problem was ich bis jetzt ausmachen konnte ist die Kenntlichmachung von Veränderungen um eine Verwechslung zu verhindern. Hier gilt im Prinzip schon, was ich geschrieben habe: Wenn du einen politischen Diskurs führst, wird es deine Version eines Textes immernoch auf deiner Seite geben, alles andere wird von der attribution-klausel in Kombination mit der im internationelen Urheberrecht implizit verankerten non-advertisement-klausel geregelt. Im Endeffekt, muss unter jeden Derivat dann drunterstehen, dass es Teile von dir enthält, ohne dass mit deinem Namen gegen deinen Willen für das Derivat geworben werden darf. Dass irgendjemand den Sinn verfremden kann, indem er in einem Aufsatz immer das Wort "Nazi" durch "Astronaut" ersetzt und alle Satzzeichen weglässt, ist klar, aber hat das wirklich negative Folgen für eine Gesellschaft wenn Verwechslung mit den Originalautor ausgeschlossen wird?
Und was die nicht eindeutige Zuordbarkeit angeht, könnte ich Frage was denn nun ein Film wie Blood Diamond z.B. ist. Ein typischer (spannender) Hollywood FIlm, also Unterhaltung, oder wegen seiner Gesellschaftskritik, ein poltisches, also Meinungswerk?
Aber wie gesagt, der Kampf um Freiheit in Musik/Filmen ist nicht Aufgabe von FSFE, das würde den Kampf um Freiheit in Software sehr beschädigen.

Das liesse sich auch anders betrachten: Da wir Profis (= bezahlte Hauptberufler) zur Erstellung von Inhalt haben möchten, stellt sich die Frage der Finanzierung. Werke als Ware funktionieren zumindest ein bisschen in dieser Hinsicht.
Bei Software, speziell der welche heutzutage häufig gebraucht wird, z.B. Webbrowser, Email-Programm, Schreibprogramm, kommt der funktionale Charakter aus meiner Sicht mehr raus. Sie sind einfach wichtiger, als das Ändern eines Hollywoodfilms.

ich möchte mir erlauben, noch einmal die Böse-Lizenz/Liebe-Lizenz-Diskussion aufzugreifen, weil ich sie einfach zu interessant finde :).
NC macht ein funktionales Werk unfrei (ich glaube hierin waren sich alle bisherigen Teilnehmer der Diskussion einig).

Bei Dokumentation nimmt es mir Freiheit! Bei Software nimmt es mir Freiheit! Bei einem Lexikon nimmt es mir Freiheit. Das sind aber alles funktionale Werke.
Ich halte diese Aufteilung von Werken, die unter das Urheberrecht fallen, in "funktionale" und "nichtfunktionale Werke" ehrlichgesagt für wenig zielführend, da sie subjektiv ist und eigentlich nur von dem Einzelnen im konkreten Fall getroffen werden kann.
Natürlich stellt Software tendenziell eher ein "funktionales" Werk dar als z.B. ein Hollywood-Film. Aber wir sollten hier imho nicht zu sehr mit einer Hacker-Perspektive herangehen. Einem Musiker nimmt ein Musikstück, das unter NC oder unter ND steht, unter Umständen viel mehr Freiheit als eine semifreie Software, die er zu ändern in vielen Fällen eh nicht in der Lage ist; oder einem Bürgerrechtsaktivisten eine Grafik unter ND, die er eigentlich gerne für seinen Flyer verwenden würde und die er dazu anpassen muss (einen Ausschnitt wählen, Kontrast ändern etc.). Falls er den Flyer in gedruckter Fassung gegen Geld vertreiben möchte, um seine Unkosten zu decken und Spenden für den guten Zweck zu sammeln, kann er auch keine Werke mehr mit NC verwenden. Ich spreche aus eigener Erfahrung ;-).
Wie man zu diesen Fragen steht, hängt vermutlich auch stark davon ab, ob man das "free" in freie Software und freie Inhalte als deskriptive oder normative Aussage sieht --- also ob man der Meinung ist, dass alle Inhalte frei sein sollten oder nicht. Ich persönlich gehe mit der Definition von freedomdefined.org d'accord, da die vier Freiheiten für mich freie Inhalte und freie Kultur ausmachen [1]: dass man sie zu jedem Zweck verwenden (0), sie studieren (1), sie verändern (1) und (veränderte Versionen) weitergeben kann (2+3). Damit hängt zusammen, dass ich nicht der Meinung bin, dass alle Inhalte notwendigerweise frei sein *müssen* --- nicht einmal alle Software; für mich ist das "frei" also deskriptiv.
Ich will auch gar nicht verneinen, dass bei manchen Arten von Werken die Freiheit wichtiger ist als bei anderen. So glaube ich schon, dass es für die Demokratie und Freiheit einer (Informations-)Gesellschaft sehr zuträglich ist, wenn
a) ein Großteil der von ihr eingesetzten Software --- insbesondere essentielle Teile wie der BS-Kernel, Systemsoftware (glibc, gcc, etc.) --- frei ist oder zumindest
b) für jeden bedeutenden Anwendungsfall eine funktionierende freie Alternative existiert.
Aber man sollte das, wie gesagt, nicht verallgemeinern. Zum Beispiel sehe ich persönlich nicht, warum ein Computerspiel wie World of Goo [2, 3], das ich fast schon als Kunstwerk betrachte, nun unbedingt frei sein muss: Das Vertriebskonzept sagt mir zu [4], der Preis ist veretretbar, die Software ist DRM-frei und es wird für GNU angeboten (hoffentlich endlich bald mal! - noch läuft es nur unter Wine). Was will ich mehr? ;-) Okay: Nun will vielleicht jemand darin herumhacken oder das Spiel auf eine andere Plattform portieren und diese neue Version auch seinen Mitmenschen zur Verfügung stellen. Aber hier sehe ich keinen großen Unterschied zu einem Spielfilm, den jemand gerne remixen würde oder den er anderen in einem anderen Format (damit er z.B. auch auf dem Openmoko läuft :-)) gerne zur Verfügung stellen würde. Beides sind für mich Kunst-/Unterhaltungswerke.
Noch ein Beispiel: Open Access. Zu der Frage, ob für den offenen Zugang zu wissenschaftlichen Informationen tatsächlich all diese vier Freiheiten (die auch in der Berlin Declaration [5] für Open Access vorgesehen sind) von Nöten sind, hatte ich eine sehr interessante Diskussion mit einem Rechtswissenschaftler auf den 2. Berliner Open-Access-Tagen. Wir sind zu dem Schluss gekommen, dass zumindest für Aufsätze (für Primärdaten sieht das schon wieder ganz anders aus) eigentlich der kostenlose Zugriff und die Kopierbarkeit ausreichend sind. Denn bei Open Access geht es in erster Linie darum, dass man kostenlosen Zugang zu den Information (also den Ideen) erhält, und eben nicht so sehr um *freie Kultur*; also das Remixen von bereits veröffentlichen Aufsätzen. Aber auch dazu gibt es andere Ansichten von durchaus rennomierten Leuten [6].

Interessant finde ich außerdem, dass die FSF für Werke der Meinung zwar ND-Lizenzen "erlaubt", diese aber in der Liste nicht als "freie Lizenzen" bezeichnet: http://www.fsf.org/licensing/licenses/index_html#OpinionLicenses
