Solche Werke würde ich unter CC-BY-SA oder CC-BY stellen. Dann können sie beliebig weiterverarbeitet werden und man kann sich relativ leicht an die Lizenzbedingungen halten.

Der Inhaber und der Admin-C sind verfügungsberechtigt. Von daher musst du wissen, wen du da am besten einträgst. Wenn das du persönlich bist, hast du halt den Vorteil, dass du die Domain auch umziehen kannst, wenn die juristische Person, die hinter dem Projekt steht, nicht mehr existiert. Es spart halt manchmal Papierkram, wenn du persönlich verfügungsberechtigt bist. Zumindest kenne ich das aus der Arbeit so. Andererseits hat die juristische Person ein Problem, wenn du persönlich Inhaber und Admin-C bist und irgendwann ausscheidest. Das merkt dann vielleicht keiner und irgendwann haben die Probleme die Domain umzuziehen oder Änderungen zu machen.
Angenommen als technischer Administrator würde ich auch als Privatperson Inhaber der Seite sein:
Es ist ja nicht ausgeschlossen, dass bspw. von der auch noch so gewissenhaft arbeitenden Community durch Publikation eines Dokuments bspw. eine Urheberrechtsverletzung begangen wird. Natürlich will man für so etwas nicht haften.
Ich glaube kaum, dass das allein am Inhaber der Domain bzw. am Admin-C festgemacht wird. Du wirst ja wahrscheinlich ein Impressum haben und wenn da ein Verein oder ein Unternehmen drin steht, sind vermutlich erst mal die haftbar und nicht du, auch wenn du Domaininhaber bist. Aber ich denke, dass du im Zweifelsfall zumindest reagieren müsstest und z.B. die Seite abschalten, wenn dadurch die Rechtsverletzung beendet werden kann. Aber ich bin kein Anwalt und das kann sicher jemand anders besser beantworten. Ich kann nur allgemeine Beispiele beschreiben (mehr darf ich auch gar nicht).

OpenStreetMap hatte auch CC-BY-SA und hatte stets Probleme, dass viele Leute die Daten nicht richtig nutzen konnten, weil die Nennung von Tausenden von möglichen Autoren nicht grade leicht zu bewerkstelligen ist. Dann wurde vor einiger Zeit mit enormem Aufwand von dieser Lizenz auf eine eigene umgeschwenkt, die wieder irgendwelche Restriktionen enthält und nach wie vor wird OSM für vieles nicht genutzt wo es angebracht wäre.
CC-0 ist auch eine mögliche Lizenz für Daten. Wenn du nicht vor hast, das Projekt zu monetarisieren, dann ist es vielleicht auch gar nicht so schlimm, wenn andere damit wirklich alles machen dürfen was sie wollen. Die Gefahr, dass jemand eine Kopie dann versucht zu verkaufen ist schon da, aber immer nur die Kopie. Die Originaldaten sind ja weiterhin frei und es tut dir keinen Abbruch, wenn jemand anderes damit Geld verdient (sofern jemand das Produkt kauft).

Deine Beispiele mit OSM und CC-BY waren sehr interessant, danke. Trotzdem denke ich, dass es bei der Lizenzwahl nicht nur um den eigenen Nutzen geht, sondern auch um moralische Fragen. BY in diesem Fall ist zwar von der Praktikabilität sehr problematisch, aber ich kann gut verstehen, wenn ein Projekt, bei dem womöglich auch viele Ehrenamtliche mithelfen, das SA-Element verwenden. Die Daten können dann zwar auch weiterhin kommerziell verwendet werden (von der NC-Klausel ist oftmals sowieso abzuraten [1]), aber die Weitervererbung der freien Lizenz ist gesichert (ähnlich dem GPL Copyleft).

Das ist auch die neue Lizenz. :) Bei der alten Lizenz stand etwas ähnliches als zusammenfassende Richtlinie da, allerdings waren da viele Stimmen, die das für nicht vereinbar mit der CC-BY-SA hielten, da man den Urheber als natürliche Person nicht ermitteln kann ohne mit Spezialsoftware in den History-Daten des Projekts zu suchen.
Die neuesten Reaktionen potenzieller Datenverwender kenne ich nicht, aber im Zuge der Umstellung sind auch zur neuen Lizenz einige Bedenken angemeldet worden, ob die von dir zitierte Zusammenfassung in einigen Grenzfällen wirklich so mit dem wirklichen Lizenztext zusammen passt. Anwaltskram, du weißt schon, vor Gericht und auf hoher See...
Möglich, dass das nur Denunzianten waren und mittlerweile klar ist, wie man alles zu handhaben hat. Aber es gab definitiv einige Unsicherheiten vor und nach der Lizenzumstellung, die keine einfache Antwort erhalten haben.

Warum sollte man kommerzielle Nutzung überhaupt ausschließen? Ist da bei Daten ein Unterschied zu Software?

Der Unterschied zur Software liegt meiner Meinung nach in der Gruppe der Autoren (Kreative, keine Techniker). In der kreativen Branche ist es irgendwie vorherrschende Meinung "Wenn ich damit kein Geld verdienen will, darf das auch niemand anderes tun."
Zudem kommt es mir so vor als wären "Daten" tendenziell öfter eigenständige Werke also lizenzrechtlich nicht auf anderem aufgebaut. Daher beschäftigt sich der Autor nicht so intensiv mit Lizenzen und kommt dann (ich bin der Autor, ich darf bestimmen!) zu obiger Milchmädchenrechnung und zu einer NC-Lizenz.
Ich hatte immer gedacht, durch zahlreiche Urteile die schon ein Weblog mit Werbung als kommerzielles Angebot einstufen würde sich durchsetzen, das als Irrweg zu sehen. Aber irgendwie sieht man doch noch überall NC-Lizenzen...

Hm, dann müssen wir da wohl noch mehr aufklären, dass man Freie Daten genau wie Freie Software auch für Geld, d.h. kommerziell weitergeben darf und dass das natürlich auch für den Urheber bzw. Rechteverwerter gilt.

erst mal danke für die vielen Tipps. Ich will es mal etwas konkreter machen:
Stufe 1 könnte sein: Ich bin als Privatperson Eigentümer der Seite (Webanwendung als Frontend einer Datenbank) und Admin-C. Nur ich veröffentliche darin und typischerweise werden so Links wie der Folgende den Dateninhalt bestimmen: http://www.ncbi.nlm.nih.gov/pubmed/15629260 Ich werde einige Bilder verwenden, die z.B. unter der "GNU-Lizenz für frei Dokumentation" stehen. Die Anwendung ist mehrsprachig. Frage: Wie sollte das Impressum gestaltet sein? Gibt es rechtssichere Vorlagen bzw. wo?
Stufe 2: Die Webseite kann "von außen" von einer Community gepflegt werden, ich bin aber immer noch Eigentümer und Admin-C. Diese hat auch die Möglichkeit Dokumente hochzuladen. Fall a) Community-Mitglied Horst lädt ein Dokument hoch, was er selbst erstellt hat. Wenn im Impressum steht, dass die hochgeladenen Dokumente der Lizenz, sagen wir CC-BY, unterliegen, steht jedes hochgeladene Dokument dann unter dieser Lizenz? deine Beschreibungen erfordern rechtliche Bewertungen für deinen speziellen Fall. Da wird dir wahrscheinlich nur ein Anwalt weiterhelfen dürfen. Ich denke nämlich, dass wir da schon im Bereich der Rechtsberatung sind wenn wir uns solche Details ansehen.

Gängige Impressumgeneratoren sollten Dir da viel abnehmen können. Mit ein bisschen Recherche sollten sich auch Leitfäden für die Definition von Lizenzen erfahren lassen.

Meines laienhaften Wissens nach nicht. Horst hat es ja selbst erstellt. Ich weiß aber nicht, ob beim Hochladen ein Hinweis wie "Durch das Hochladen stimmen Sie zu, die Lizenz des Werks in CC-BY festzulegen" rechtssicher ist. Da sollte ein Anwalt helfen.
Fall b) Community-Mitglied Atze lädt ein Dokument hoch, was einer Lizenz unterliegt, die eine Weitergabe verbietet. Was wäre die Konsequenz? Es ist ja wahrscheinlich nur sehr schwer möglich, jedes hochgeladene Dokument zu überprüfen.
Ich denke, es wird dabei so wie bei den berühmt berüchtigten Sharehostern sein. Die manuelle Prüfung auf Urheberrechtsverstöße ist dem Betreiber nicht zuzumuten, er muss aber auf einen Hinweis hin die Löschung vollziehen.
Stufe 3 wäre, dass die Webseite in die Hände eines Vereins überführt wird. Was würde sich hier gegenüber 2. ändern?
Meiner laienhaften Meinung nach nicht viel.
Aber wie von Florian gesagt: Investiere lieber in eine anwaltliche Beratung als Dich auf unsichere Aussagen zu berufen und womöglich Ärger und/oder viel Aufwand zu riskieren.

Es gibt soweit ich weiß keine rechtlichen Probleme beim Setzen von Links. Wissenschaftliche Artikel im Volltext sind in aller Regel nicht so lizenziert, dass du deren Inhalt frei veröffentlichen darfst, aber einen Link auf eine anderswo veröffentlichte Zusammenfassung ist kein Problem. Das macht Wikipedia ja auch als Referenz bei sehr vielen Artikeln.

Die GNU FDL hat ihre Tücken. FDL und CC-BY-SA sind nicht (mehr) kompatibel, du musst sicher stellen, dass bei jedem Element die richtige Attribution angezeigt wird.

Nein, das ist nicht möglich. Wenn du FDL-Material hochlädst, kann das nachher nicht unter CC-BY stehen. Die Ausnahmeregelung zur Lizenzänderung der Wikipedia ist nur ein paar Monate gültig gewesen.

Ein Verein ist eine juristische Person. Eine juristische Person wird oft benutzt um Haftung von einer natürlichen Person abzuwenden. Aber soweit ich weiß ist der Vorstand eines Vereins doch noch vergleichsweise stark haftbar, wenn es um Urheberrechtsverstöße geht. Aber du hast ja schon Antworten bekommen, die dir eine Rechtsberatung nahe legen.

Ich selbst nutze öfter Bilder in Präsentationen die CC-0 lizensiert sind und die ich von einem Webportal herunterlade, zu dem die Gemeinschaft Bilder beiträgt. Der Portalbetreiber wählt die guten aus und stellt sie in einem nach Stichworten durchsuchbaren Archiv allen zur Verfügung. Der Betreiber ist nicht in der Verpflichtung dieses Archiv bis in alle Ewigkeit zu betreiben, es hindert ihn nichts daran die Seite irgendwann dichtzumachen und die Bilder (sind ja alle CC-0) zu verkaufen.
Ich glaube das ist die Angst der Künstler - dass ihre Werke, die sie zum Wohl der Allgemeinheit zur Verfügung gestellt haben, plötzlich eben nicht mehr der Allgemeinheit zugänglich sind, aber ein Einzelner dann Geld damit verdient.
Und mit der Angst muss sich jeder auseinandersetzen, der eine Platform betreibt auf der die Community aufgefordert ist urheberrechtsfrei Beträge zu leisten.

Das Problem lässt sich ganz einfach lösen bzw. macht das in der Regel der Markt. Dafür gibt es zwei Lösungsansätze:
1. Die Veröffentlichung/Sammlung erfolgt über einen Verein oder eine Stiftung, in deren Statuten die freie Verfügbarkeit festgeschrieben ist. Dann müssen sich schon mehrere Leute gemeinsam stark anstrengen um das zu kommerzialisieren.
2. Es gibt mehrere solche Portale und man lädt sein Werk bei mehreren hoch. Es wird einem davon nicht viel bringen, wenn er die selben Daten dann verkaufen will.
Und mit der Angst muss sich jeder auseinandersetzen, der eine Platform betreibt auf der die Community aufgefordert ist urheberrechtsfrei Beträge zu leisten.
Ich verstehe auch in diesem Fall nicht, was der Urheber da für eine "Angst" haben kann. Ja, man hat etwas erstellt und man will auch beachtet werden. Am besten im Rahmen einer Sammlung mit oft genutzter Bewertungsfunktion, ganz klar. Aber wenn nicht, dann halt nicht, ärgerlich aber nichts wirklich relevantes. Man hat ja sein Werk weiterhin und es gibt doch unzählige andere Wege es der Allgemeinheit zur Verfügung zu stellen.

Deswegen bitten wir in der Gemeinschaft rund um Freie Software und Freie Kultur in der Regel auch niemanden, urheberrechtsfrei Beiträge zu leisten. In Deutschland geht das sowieso nicht, aber wir verlangen auch gar nicht, dass jemand alle Rechte abtritt. Üblich ist es, dass der Autor alle Rechte behält und zusätzlich die Gemeinschaft eine Lizenz erhält, die die vier Freiheiten garantiert. Und wenn man nicht will, dass das Werk unfrei wird, sollte man eine Lizenz mit starkem Copyleft wählen. Dazu würde ich sowieso raten.
Kommerzielle Nutzung ist eine Frage, die nur insofern damit zu tun hat, als dass der ausschluss kommerzieller Nutzung ein Werk unfrei macht. Aber wenn jemand einen Weg findet mit freien Werken unter Beibehaltung dieser Freiheit, Geld zu verdienen, dann hab ich da nichts dagegen.
