In München findet am kommenden Wochenende der Corso Leopold, ein buntes
Straßenfest auf der Schwabinger Leopoldstraße, statt. [1]
Erstmalig mit dabei ist ein von lokalen Free Software-Aktivist_innen
organisierter Stand zu Freier Software und freien Inhalten.
Wir werden verschiedenes Material von Mozilla, The Document Foundation,
Wikimedia, FFII, Medifloss, OpenSource-Treffen [2], dem Cafe Netzwerk [3], der
FSF sowie FSFE verteilen und die Besucher_innen über Freie Software,
insbesondere den Alternativen zu propritärer Software, informieren.

Das Landgericht Hamburg hat die FANTEC GmbH für schuldig gesprochen[1],
in dem Media Player FANTEC 3DFHDL die GNU General Public License zu
verletzen. Im Fall Harald Welte gegen FANTEC GmbH hat das Gericht
entschieden, dass FANTEC eine Strafzahlung zu begleichen hat und zudem
für zusätzliche Kosten der Anwälte aufkommen muss. Des Weiteren muss
FANTEC Herrn Welte exakte Auskunft über die Vertriebswege des FANTEC
3DFHDL Media Player erteilen.
FANTEC verwendete die netfilter/iptables Software (Firewall Software für
GNU/Linux) in einer der online zur Verfügung gestellten Firmwares für
das FANTEC 3DFHDL. Diese Firmware wurde jedoch ohne den dazugehörigen
Quellcode verteilt. Das ist allerdings von der GNU General Public
License Version 2 (GPLv2) vorgesehen, unter welcher netfilter/iptables
veröffentlicht wurde. Versuche, diese Problematik außergerichtlich zu
lösen, schlugen fehl, weshalb Harald Welte, einer der Rechte-Inhaber von
iptables, vor Gericht ging. Das Gericht entschied, dass FANTEC
fahrlässig gehandelt habe: Sie hätten dafür Sorge tragen müssen, dass
sie sich bei der Verbreitung der Software an die Bedingungen der GNU
GPLv2 halten. Das Gericht hat zudem explizit darauf hingewiesen, dass es
seitens FANTEC ungenügend ist, auf die Zusicherung seiner Zulieferer
bezüglich der Lizenzeinhaltung zu vertrauen. Hingegen ist FANTEC selbst
dafür verantwortlich, nachzuprüfen, dass keine Rechte Dritter verletzt
werden.
"Es ist erfreulich zu sehen, dass das Gericht die Verantwortung über
die Einhaltung der GNU GPL Lizenz beim Verkäufer sieht. Speziell
FANTEC, die bereits in der Vergangenheit mit Nicht-Einhaltung der GNU
GPL aufgefallen sind, hätten es eigentlich besser wissen müssen. Das
war reine Faulheit." sagt Harald Welte, Gründer von gpl-
violations.org[2]und Ankläger.
Diese GNU-GPL-Verletzung wurde von der Free Software Foundation Europe
während eines "Hacking for Compliance Workshop" im Mai 2012 in Berlin
gefunden. Mehrere Freiwillige haben dabei geholfen, verschiedene Geräte
auf die Einhaltung der GNU GPL Lizenz zu überprüfen. Im Anschluss wurden
die Ergebnisse an gpl-violations.org und deren Anwälte weitergeleitet,
die diese Verletzungen weiter verfolgt haben.
Obwohl FANTEC den Vorwurf zunächst abgestritten hat, war es den
Ehrenamtlichen der FSFE und gpl-violations.org möglich zu zeigen, dass
sich die Software iptables version 1.3.7 auf dem strittigen Gerät
befunden hat, aber FANTEC nicht die Quellen des Programms in der
bereitgestellen Software angegeben hat. Zudem konnte gezeigt werden,
dass die Software an einem anderen Tag kompiliert als angeboten wurde,
und damit der von FANTEC angebotene Source Code veraltet war.
"Gemeinsam mit unseren ehrenamtlichen Helfern werden wir weiter
garantieren, dass Benutzern die Freiheiten gegeben werden, Software zu
verwenden, zu verstehen, zu verbreiten und zu verbessern. Das sind die
grundlegenden Prinzipien der Freien-Software-Gemeinschaft und jedes
Unternehmen, welches diese Software vertreibt, muss diese Lizenzen
dementsprechend befolgen. Unternehmen sehen offensichtliche Vorteile
darin, auf Freier Software aufzubauen, deshalb sollten sie diese
simplen und grundlegenden Regeln einhalten." sagt Matthias Kirschner,
FSFE's Deutschlandkoordinator und einer der Organisatoren des
Compliance Workshops.

In recent weeks, political events [1] in Istanbul have been the focus of
international media. Important discussions are taking place about
Turkey's government and her people. Several have lost their lives in the
process.
Days before the protests in Taksim Square erupted, President Erdoğan was
in America. On behalf of an ambitious education investment project
called FATIH [2], he toured Silicon Valley as the guest of America's
largest technology companies, each of whom are hoping to land a contract
for more than 10 million new tablet computers.
As the safety and freedom on the street of Turkey's activists is hotly
debated in the press, the safety and freedom of her children to learn
has understandably received much less attention. Whether it is publicly
discussed or not however, $5 billion will soon be spent on education,
and it's impact on the rights of the next generation of Turkey's
students will be immense.
FSFE's Education Team [3] is dedicated to empowering students via Free
Software. If you think that humans deserve rights over the technology

Recently you visited America [5] to discuss the acquisition of 10.6
million tablets from leading technology companies for students, on
behalf of Turkey's project FATIH [2].
We urge you to take alternative products into consideration, and
consider the impact of the software those tablets use.
Google, Apple, and Microsoft, who hosted you, all tie their tablets to
software which would prevent Turkish children from studying and
customising it. The companies you spoke to enforce strict proprietary
licensing which would ensure that schools could only lease their ability
to use applications, not own them or rights to them.
Free Software [6], contrastingly, protects students' rights to use,
study, share, and improve it. In an educational context these rights can
make the difference between consumers and creators. Without these
freedoms, the 17 million students affected by your plan cannot
experiment or develop the understanding necessary to lead digital
economies in future.
Software support and maintenance is expensive, and proprietary software
exacerbates these costs by restricting who can provide you with
services. By using Free Software, Turkish schools would lose their
dependency on a single vendor, and competition for service contracts
could be more local, and more competitive.
Finally, for better security of both schools and students, Free Software
makes its code available, providing evidence of how it functions. This
week's revelations surrounding British Government spying on Turkish
politicians [7] at the G20 summit highlight the importance of software
security and privacy. Educational computers should not provide
back-doors [8] for foreign Governments and companies.
Apple [9], Google [10] and Microsoft [11] all embrace Free Software
themselves, and use it internally. Making the step towards Free Software
tablets is important however, and several global manufacturers and
distributors offer Free Software devices for sale. Will the freedom of
Turkey's citizens be considered in your forthcoming decision to purchase
tablets?
